White House Directs Kellyanne Conway to Defy House Subpoena

Source: New York Times

WASHINGTON — White House officials directed Kellyanne Conway on Monday not to comply with a congressional subpoena compelling her to answer to accusations of multiple violations of a federal ethics law, invoking the “longstanding principle of immunity for senior advisers to the president.”

The House Oversight and Reform Committee authorized a subpoena for Ms. Conway last month after Henry J. Kerner, a special counsel for a nonpartisan government watchdog agency, told the committee that Ms. Conway should be fired from the White House for her “egregious, repeated and very public violations” of a federal ethics law called the Hatch Act, which prohibits federal employees from engaging in political activities at work.

But President Trump has vowed to defy all subpoenas, and on Monday, when Ms. Conway was due to testify, Pat Cipollone, the White House counsel, told Representative Elijah E. Cummings, Democrat of Maryland and the chairman of the oversight panel, in a letter that she would ignore the summons. Invoking the claim of absolute immunity, Mr. Cipollone wrote that “in accordance with longstanding, bipartisan precedent, Ms. Conway cannot be compelled to testify before Congress with respect to matters related to her service as a senior adviser to the president.”

The move is the latest turn in a growing confrontation between the House and the executive branch, as they battle over just how far Congress’s oversight power extends and whether a president’s senior aides are “absolutely immune” from subpoenas. The White House has blocked testimony from a number of the president’s top aides, current and former, invoking that claim.

2. All they have to do is throw one

of these traitors in jail for a couple of days, and they will all start to sing.

Any good parent knows that if the kid doesn't encounter what you are threatening them with at least once, they will just keep pushing the limits.

4. They ARE above the law so long as nobody enforces the law.

So far they've totally gotten away with ignoring subpoenas. So long as there's no incentive for gopers to comply they most certainly won't. We're getting very impatient Speaker Pelosi !!!!!!!!!

11. Correct...They have all gotten away with not answering subpoenas

wouldn't you say they ARE above the law? I think I would. They know the law will not come after them so they just let those who filed the subpoenas bark, they don't seem to follow up with a bite. The list just piles up...McGhan, Hicks, Barr, Don Jr (I count him because his show to testify was a waste) lets see how many of the 37 Muller witnesses will.

At this time the only thing that will work is Impeachment, even if the Senate will not enforce it, get all the information out in the open, let everyone know the level of corruption from this administration.

5. Maybe someone should tell Pelosi about the whitewater hearings

Susan Carol McDougal (née Henley; born 1955) is one of the few people who served prison time as a result of the Whitewater controversy of the 15 individuals who were convicted of federal charges.

Her refusal to answer "three questions" for a grand jury, on whether President Bill Clinton lied in his testimony during her Whitewater trial, led her to receive a jail sentence of 18 months for contempt of court. That made up most of the total 22 months she spent incarcerated.

She received a full presidential pardon from Clinton in the final hours of his presidency in 2001.

6. Enough is enough

Why isn't this obstruction of Justice? Pelosi better wake up and start doing her job. If these misfits don't answer subpoenas, then have Federal Marshall pick them up, handcuff them and haul them off. Even if they stay in the cell for one hour at least they will know that these subpoenas are not idle threats.

13. Most probably...

Bark, no bite.

I am so tired of watching Nadler being interviewed, his favourite answer is "I cannot say anything about that at this time" with a little smirk, as if he has this great secret that is going to force all the crooks to testify, to answer the subpoenas, and then...silence, total silence about the unanswered subpoenas. How many of us had already forgotten about the unanswered subpoenas from Hicks, McGhan? About the lack of testimony that Don Jr provided?

I want to believe that Pelosi and Shumar have this grandiose plan, of which we know nothing about at this time, and suddenly...BOOM! all the crooks are marching in orange suits to jail. But I am becoming very frustrated to see nothing happening, the crooks getting away with everything, the creature becoming more empowered by the day.

I don't think Graham would have ever said anything like he said a couple of day, about migrants, in the past but the empowerment they feel from the lack of visible action from democrats are making them believe, rightly so, like they can say, do anything evil and corrupt and no consequences will come out of it. The more empowered they feel, the worst things are going to come from them.

8. Our guys should press the other Repugnants in Congress on the whole issue of Presidential oversight

and get them on the record on their position on it by holding people like Barr in contempt of Congress and seeking their impeachment from office.
Then during the next election we can use it like a hammer against all of them no matter if they vote to convict in the Senate or not.

10. WH thinks it has a "longstanding principle of immunity" from the law

"If senior advisers to the president do it, it's not illegal."

12. Since many things have been tweeted by her husband

there isn't any spousal privilege on those matters. The House should subpoena him.

15. They can't ignore a court subpoena

At some point, these assholes will have to come before a judge that knows the Constitution demands Congressional oversight, and will enforce the law. He WILL have them arrested for not appearing.

Haven't these cases been filed?
