Chelsea Manning: Wikileaks source released from jail after refusing to testify

Source: BBC

Former US intelligence analyst Chelsea Manning has been released from prison, despite refusing to testify before an investigation into Wikileaks.

Manning, 31, was held for 62 days after a Virginia judge ordered her taken into custody in March.

However, she will have to appear again before a grand jury on 16 May.

Manning was found guilty in 2013 of charges including espionage for leaking secret military files to Wikileaks, but her sentence was later commuted.

5. If she refuses to testify on May 16, she should go back to jail.

Contempt of court is serious. She should get no special breaks. She should sit in jail until either the grand jury is released or she purges herself of the contempt by testifying.

8. THe purpose of jail is to compel the testimony.

If the judge doesn't think it will work, he has no reason to keep her locked up.

9. And you cannot know if a contemptuous witness will or will not testify

until she either testifies or the grand jury is excused. Her saying she will not testify is interesting but not persuasive.

Federal judges do not suffer contempt gladly.

16. Judges have too much power.

They act like kings. I’m happy when someone tells them “no”. It needs to happen more often.

If she doesn’t want to testify, I’m sure she has her reasons. Maybe she’s protecting someone. Maybe she doesn’t trust the government, and she’d be right to feel that way. She needs to just vanish, and try to put all of this garbage behind her.

18. Well, the very public career she's pursuing does not

allow her to disappear, nor is there the slightest indication that she would want to. Quite the contrary.

We don't know if she's refusing to comply in part out of some personal conviction that our courts should be defied, but we can assume it will benefit her by furthering the public persona she's built a career on. She has a book on the market now and has a deal for another one, and of course she does speaking engagements. To increase demand for books and appearances, and to be able to raise her fees, she must both feed the perceptions that create that demand and, especially, attract media attention to give her brand exposure.

17. Would agree anyway, but respect your experience.

Apparently the subpoena she was jailed on expired and the grand jury was released, but yet another grand jury subpoena has been issued.

10. She was only relaeased because the term of the grand jury expired.

If she refuses to testify before the new grand jury she'll be back in jail for the term of the that GJ.
