Trump announces Kavanaugh replacement for DC circuit court

Source: The Hill

President Trump announced Tuesday he is nominating Neomi Rao to fill Supreme Court Justice Brett Kavanaugh’s vacant seat on the US Court of Appeals for the D.C. Circuit.

Rao currently serves as the administrator of the Office of Information and Regulatory Affairs (OIRA.

She is a vocal advocate of Trump’s efforts to slash government regulations, crediting the reductions with stimulating job growth.

“I think the reform efforts are part of what has stimulated economic growth and job creation and promoted technological innovation. And from my perspective, our reform efforts have really focused on promoting the rule of law and emphasized the productivity and potential of the American people that’s possible when you get rid of unnecessary economic burdens,” Rao said at an American Bar Association conference earlier this month.

2. Might be time for our guys in the House to explain to certain Repugnant Senators

that if they approve this nomination that the House might decide to exercise the power they have to not spend money in certain places when it comes time to do the next budget.

5. Another Federalist Society member getting a lifetime appointment at age 45

to the second most influential court in the nation--only SCOTUS decisions are more significant. Trump continues to reshape American society in his own image for the next three generations.

Putin must be proud. His "investment" in Donnie Two Scoops is turning out better than he imagined.

6. The D.C. Circuit is currently 7 (D) - 3 (R)

In the fall of 2013, Harry Reid used the nuclear option in order to allow Obama to finally fill the vacancies on that specific court (among others).

How Barack Obama Transformed The Nation’s Courts

<...>

Obama will leave office with 329 of his judicial nominees confirmed to lifetime posts on federal courts. That includes two U.S. Supreme Court justices and four judges on the D.C. Circuit Court of Appeals, the two most powerful courts in the nation. Because of Obama, Democratic appointees now have a 7-4 advantage on the D.C. panel, and those judges will play a major role in deciding cases during the Trump administration related to environmental regulations, health care, national security, consumer protections and challenges to executive orders.

That "4" GOP would have included Kavanaugh who left leaving the court at 7 - 3.

8. You are welcome and might I add this from the same link -

Obama also tilted the partisan makeup of circuit courts. Nine of the country’s 13 appeals courts now have majority Democratic appointees, compared with just one when he took office in 2009.

We may have been fucked at the top court but there is a bit of a firewall before anything would reach there and the Circuits are where most cases end (there is no way that the SCOTUS can hear thousands and thousands of cases each term).

9. Know who makes the initial decision of which cases the Justices will consider? Their law clerks.

There is no way the justices have time to winnow through the tens of thousands of writs of certiorari, so it is the clerks -- most just out of law school -- who decide which cases proceed to the next level of the selection process.
