No. 3 Official at the Justice Department Is Stepping Down

WASHINGTON Rachel L. Brand, the No. 3 official at the Justice Department, plans to step down after nine months on the job as the countrys top law enforcement agency has been under attack by President Trump, according to two people briefed on her decision.

Ms. Brands profile had risen in part because she is next in the line of succession behind the deputy attorney general, Rod J. Rosenstein, who is overseeing the special counsels inquiry into Russian influence in the 2016 election. Mr. Trump, who has called the investigation a witch hunt, has considered firing Mr. Rosenstein.

Such a move could have put her in charge of the special counsel and, by extension, left her in the cross hairs of the president.

Ms. Brand, who became the associate attorney general in May 2017, is leaving for a job as general counsel in the private sector. She has held politically appointed positions at the Justice Department over the past three presidential administrations.

Ms. Brand’s assistant, Currie Gunn, has also left the department. Ms. Gunn could not be reached for comment.

This is the only reason, I think, that Mueller hasn't been fired yet.

The Dems win the 2018 election and Impeach? Anything beyond that? Because I still lay his odds at re-election >50:50, even if a conspiracy is documented.

17. I think in order to fire Mueller, the attorney has to be confirmed....however, could the person be

confirmed in say a different department?

Say the assaulter in chief fires Sessions and Rosenstein, could the con then name Pruitt as the acting AG and have Pruitt, who has been confirmed by the Senate for his position, get rid of Mueller?

26. No. They would have to be confirmed for this appointment.

The advice and consent clause of the Constitution would require the Senate to confirm the new appointee, even if the appointee holds an appointment within a different position within the executive branch.

43. That's not the way it works.

Yes, he could put up John Douchebag, but in the interim, a career employee will fill that role. And a career employee is unlikely to be willing to fire a Special Counsel. And it's not like the President can call up someone over at Justice and ask him if they'll obey his orders to fire Mueller. He'll have to guess.

Not even the Repubs would tolerate another massacre.

Foundation , Scalia law school, , appointed by trump ,part of FL recount 2000, served under Bush , went against board when with Obama
and was like no , this person will not do a thing to save democracy and is part of the problem
so she is dropping out

35. Paul Butler, legal analyst for MSNBC had mentioned her a few months ago and he was less

than enthusiastic about her saying she was too partisan I believe. That said, if true, why would she leave? Maybe likes her place in history and didn't want to become the next Bork?

I fear for who Mueller when the replacement comes.

A former CIA official who was law school classmates with newly-resigned Associate Attorney General Rachel Brand explained to an MSNBC panel Friday afternoon that her departure may precede that of the deputy attorney general.
