Cardell Hayes, the man accused of murdering former Saints player Will Smith, was indicted Thursday (April 28) on a charge of second-degree murder. A New Orleans grand jury also indicted him in attempted second-degree murder of Smith's wife, Racquel, of aggravated criminal damage to a vehicle and on another charge of aggravated assault of Will Smith.
The indictment came during a probable cause hearing scheduled at the same time, as witnesses called by the defense testified about the April 9 double shooting. Simultaneously, prosecutors were presenting evidence and witnesses to the grand jury.
The dual proceedings provided only some of the court drama Thursday. An altercation outside the courtroom where the preliminary hearing began ended with two women led away in handcuffs. And the hearing itself was bounced to another judge's courtroom once an indictment was read -- forcing Hayes, attorneys, media and spectators into a highly unusual relocation in the middle of the proceeding.
Hayes' attorneys John Fuller and Jay Daniels, who have criticized the investigation since Hayes' arrest at the Lower Garden District crime scene after the shooting, had subpoenaed 24 witnesses for the hearing -- including Smith's former teammate Pierre Thomas.
