Oregon occupation organizer Ammon Bundy, brother denied bail
Portland, Ore.
Ammon Bundy, organizer of the armed occupation of an Oregon wildlife refuge, will remain in custody pending his trial on felony conspiracy charges, a U.S. District Court judge ruled on Friday.
U.S. Magistrate Stacie Beckerman said she believed Bundy might attempt to occupy other federal property if she allowed him to be released on bail before his trial on charges of conspiracy to use force, intimidation or threats to impede federal officers from discharging their duties.
Bundy's brother, Ryan Bundy, was also ordered held.

In a court filing Friday, prosecutors say Bundy, his brother Ryan Bundy and others "have long been associated with armed conflicts with the federal government and have repeatedly rejected the authority of the federal government, making them unsuitable for court-ordered supervision."
They cite their participation Ammon Bundy and others took part in the 2014 armed standoff with the government over grazing rights led by the Bundys' father, Nevada rancher Cliven Bundy.

(9,688 posts)They do pose a danger to the community, and they almost surely wouldn't follow orders to return to Oregon for trial and yes, they have been associated with previous armed conflicts with the federal government and they are unsuitable for court-ordered supervision.

Since neither one of the Bundy's are from Oregon, it's unlikely the trial will be held in their backyards!
There is a perfectly fine federal court in Portland, and the jury pool is very diverse.

(1,508 posts)they will get a fair trial in Portland Oregon. I also feel that the people that live in the town outside the reserve they occupied won't be too sympathetic regarding their actions. I personally feel the Bundy's and the rest of that group should be grateful for the fact that they have that thing known as white privilege in this nation. If they didn't, I don't believe they would be around to worry about bail or jail or anything else. Maybe they can be converted to Islam while they are in jail, that way the next time they try this they will see what happens when you don't have that privilege that they are taking for granted.

(1,508 posts)already sent them a barrel of lubricant, maybe the feds will be sympathetic enough to allow them to bring it into the prison. I don't think they'll need Dildos, they'll have access to the real thing.

(86,542 posts)Since they are facing federal charges they will be brought before federal judge(es)... this is part of the 9th District, might not look favorably on them, they would have had an easier time of it if they'd stayed in the 10th District.
I could be mistaken about this, if so let me know how it works.

Why should they be granted bail? They are severely high risk to violate bail in a way that's a threat to the public safety, and to law enforcement officers.
Imagine these dudes got bail and set up another armed encampment and killed a federal LE officer? What magistrate would want that to be on his or her record?

Federal courts operate a bit differently than local criminal courts.

(35,699 posts)I believe they are in for a rude awakening if they try that. Every time they go off on some "Constitutional" tangent the Federal Prosecutor is going to say, "Objection" and the Judge will sustain. After the first couple of times the Judge will have had enough and issue a warning to the defense lawyers to cut the crap.

And then they may have a bunch more charges to draw up, etc. And then their defense lawyers will need some time to do discovery - and there will be huge fights about what they are entitled to. Grazing permit records, etc. are not going to be admissible and a lot of time will be wasted before the lawyers get all that straightened out. Oh these suckers are in for a while before they even see a jury unless they can work out some kind of deal to avoid trial.

(12,165 posts)The federal government did a good job of managing this situation. I was one of the ones that wanted to see them go in and arrest them when it first started.
It's a good thing that clear-eyed people were in charge and not me.
