Abbott says state employees may withhold benefits from same sex couples

Source: Houston Chronicle

Texas Gov. Greg Abbott opened the door for state employees to withhold benefits from same-sex couples Friday, hours after the Supreme Court legalized same-sex marriage nationwide.

In a letter released Thursday afternoon, Abbott ordered heads of state agencies to prioritize religious freedom, writing that no adverse action should be taken against a state official "on account of the person's act or refusal to act that is substantially motivated by sincere religious belief."

"This order applies to any agency decision, including but not limited to granting or denying benefits, managing agency employees, entering or enforcing agency contracts, licensing and permitting decisions, or enforcing state laws and regulations," Abbott wrote.

Earlier this month, the governor signed into law the "Pastor Protection Act," which exempts private citizens from performing marriages that would cause them to "violate a sincerely held religious belief.

1. Then these bigots should not be working in the public sector!

if their churches are going to fire people and kick people out of their church for acts perceived to be against their faith then not performing one's assigned civic duties should be an offense resulting in dismissal!

47. I do hold solace in one thing, though

over the course of our history on this spinning orb, we have generally progressed forward re: society and its acceptance of traits, behaviour, etc. that have been outside the norm held by the group(s) in power.

Suffrage
Slavery
Civil Rights
LGBT rights

They either sue, and lose, or they force us to sue them, and they lose.

4. True but it is what it is and now the state pay for it and do mean pay $$ for it

because you can just bet that there will be alot of lawsuits and I suspect the state will be losing most of them especially if a state official while on the job discriminates against someone because of the governors order.

We have the most stringent tort reform in the country. If you somehow get a judgement against a corporation, the Texas Supreme Court will take it away and make up something to justify their ruling.

That's what you'll be facing unless you eliminate all spousal benefits for state employees. I'm sure that will go over well with the state employees in Texas.

I guess they wouldn't accept that there's a religious excuse for that.

They are going to fight this tooth and nail, kicking and biting, every damned inch of the way. I hope the courts come down on them HARD for this kind of nonsense.

26. This is emblematic of the mess created by the Hobby Lobby decision

The "Pastor Protection Act" is perfectly OK with me, but giving an individual state employee the right to deny benefits to people based on sexual orientation is absurd. I have no doubt that Governor Abbott is homophobic, and that his bigotry is based on sincerely held Christian beliefs. However, he is the governor of all the people in his state and he has no right to enforce the law for the benefit of some and not for others. Yet that is exactly what his order to the heads of state agencies does.

but these wingnuts are refusing federal $ for medicaid expansion and denying millions of their own constituents health care just to try and stick a thumb in the eye of the president. and apparently they are screwing themselves out of millions because of their twisted ideology. i am afraid the feds are going to have to come up with something else besides withholding $.

too bad we are not dealing with rational people.....

Abbott appears to be encouraging state employees to break the law, and telling other state employees not to enforce the law. I'd think that's impeachable in a decent system.
