Has any President been charged? Did FDR break a law colluding with Stalin in WWII?
I think Dershowitz is right. The closer case is whether Trump is guilty of obstruction of justice. Dershowitz who tilts toward protecting people charged with crimes, who usually wants to limit the reach of prosecutors, who is a defender of civil liberties, for which we should praise him rather than blast him, probably argues the President is in charge of federal prosecutions so he can do pretty much anything he wants to obstruct justice. That is a closer call and most jurisprudes probably disagree with him on that.

(30,674 posts)You say the prosecutor can't prove collusion is a crime. Prove otherwise. And then we can deal with the evidence, not hypotheticals. Dersh is all hypotheticals. He's just trying to change the subject.

The prosecutor must cite a specific law you have broken when you drank milk. He must prove exactly what you did which is forbidden by that law.
What specific law outlaws colluding with Russia? How did Trumps behavior violate that law?
If we cant meet that burden then Dershowitz is obviously correct that Trump is not guilty.

(4,533 posts)He may charge obstruction, maybe not. He may charge conspiracy to hack to get emails illegally. He may charge money laundering. He may charge submitting false financial forms to get a loan. He may charge fraud to sell real estate. I bet Trump has broken many laws. But there is no such law making collusion with Russia illegal.
