Gorsuch had no problem interpreting the clear intent of the Senates language in this case. He immediately agreed that the existing laws forbid waterboarding in any form.
Graham was quick to use this opportunity to warn the President against any attempts at fulfilling this campaign promise:
In case President Trump is watching if you start waterboarding, you may be impeached.
Gorsuch immediately acknowledged as much, replying:
Senator, the impeachment power belongs to this body. He added, No man is above the law.

This is a case of lowering a lifeboat off the ship, to see if anyone jumps in.
I suspect we'll be seeing quite a bit of this in future, as people like Graham - who have been around long enough to recognize an iceberg looming in the distance - start signaling that it's time to abandon the Trump ship.

Despite being a Republican, I do think he's cut from a different cloth than the others. He seems to be one of the old school Republicans, the kind who had ethics and would work across the aisle. His policies are Republican policies, though.

the senate conducts trials and may remove *after* the house impeaches, but that's a different power.
the power that the constitution calls "impeachment" is plainly laid out and belongs exclusively to the house.
i know, he probably meant "congress" (both houses) as opposed to the supreme court, but at best it means he was being very sloppy and imprecise. not at all the kind of mind you want on the supreme court, politics aside.
