An owner of O Face Bar, made notorious on Spike TVs Bar Rescue in 2014 and accused last month of sexually abusing a woman, will get his day in court.
The trial for Matthew Overmyer has been set for May 10.
Overmyer was arrested on Feb. 4, and has been charged with second-degree sexual abuse, a class B felony; and assault with intent to commit sexual abuse, a class D felony. On March 18, Overmyers lawyer, Michael Hooper, filed court documents saying that his defendant was going to rely on the defense of intoxication.
Messages left Friday for Hooper were not returned. Assistant Pottawattamie County Attorney Dan McGinn, who is prosecuting the case, said an intoxication defense traditionally means that the defendant was at a diminished capacity at the time of the alleged event and could not form specific intent.

The guy is an abusive asshole who would hit his own employees and get shitfaced drunk at work.

FWIW I'm of the latter opinion, legally speaking.
But rationally, ethically, medically you have to pick one. If drunkenness absolves people of the ability to understand and give consent, it absolves them of the ability to understand and form intent.
