He could take a place at a podium someplace and tell the country his preference is to have a ninth as soon as possible.
He could take a place at a podium someplace and tell the country he intends to shelve all cases that will have a 4-4 tie, placing the lower court ruling on hold.
He could prevail on his colleagues and issue a joint statement that they want a ninth.
Any of those is the right thing to do.
