Tamir's death is justified

Because "All Lives Matter" except when it's a black child.

So disgusted right now.

So the cops thought Tamir was a grown man. They thought it was a real pistol.

So what?

In an open carry state, how does that justify immediately shooting him?

How does it excuse standing and watching him bleed in the dirt without attending to his wounds?

You just have to wonder why some of the folks who trot that out don't understand that it's exactly because "all lives matter" that special attention to the value of black lives is necessary. All lives can't matter if parts of "all lives" (that is, black lives) are accorded a lesser value.

Yeah, I get that there are armed and dangerous 12-year-olds out there. That's just how fucked up our economic-injustice-ridden society is.

But if you're a law enforcement officer, a part of your job is to develop professional, accurate risk assessment skills. And professional risk assessment skills involve having the courage to take enough time to make a professional assessment, even if that increases your risk. Not racially profile a middle-schooler and shoot them within seconds of your arrival.

This is so infuriating.

20. During my recent visit to Cleveland, OH ...

 

I spoke with a member of BLM's inner circle (a cousin of a very close friend), several community activists (that I grew up with and worked with when I lived in Cleveland), a couple family members that work in the Cleveland PD, and an Asst. Prosecutor (that I went to Law school with ... she was in my Criminal Procedure study group).

And from those discussions, I came away with a couple conclusions ... specifically, a bad outcome does not constitute a crime.

First, the rookie cop that pulled the trigger was rightfully exonerated ... Yes, he shot a kid; but, the facts suggest, he was placed in a position, by his (veteran) Training Officer, that NO jury would have convicted.

However, just about everyone agreed, the veteran Training Officer should have been charged with Negligent Homicide, for "cowboying it up" and driving too fast and close to the scene, placing the rookie in a position of having to make the split second shoot/no shoot decision, from a distance of less than 6 feet, and no cover.

Now, there were other non-prosecutable problems with how the CPD handled the immediate aftermath of the shooting, i.e., failure to render aid, the treatment of the family (particularly, Rice's juvenile sister).

There, also, was a failure of the community center program ... Tamar and his sister, went to a daycare program. His sister showed up; but, Tamir didn't ... she told the operators that Tamir was outside playing and no one took the time to go get him.

There is not a jury in the world that would convict on the facts of this case ... the rookie cop was drove up to, and deposited to, within a matter of feet of someone, believed to have been armed. Bottom line, juries tend to being sympathetic to fact patterns where making a split second shot/no shot decision ... because unlike, second thinking activists, they tend to understand the price for making the wrong decision is NOT going home to your wife/husband and family. Whether I agree or disagree with the ultimate decision. doesn't change how juries/grand juries think.

The short answer is, Yes ... but the real world answer is, No ... this rarely happens, and when it does, it doesn't go anywhere because the citizens have relied on internet law; rather than, real world law.
