3. Recall of Va. Confederate flag plates meeting resistance

RICHMOND, Va. (AP) — Attorneys for a Southern heritage group are urging members to resist a recall of now-banned Virginia license plates with an image of the Confederate battle flag ...
Fred D. Taylor, one of the group’s attorneys, called the planned recall “absurd and premature.”

“The court’s decision here does not and should not affect the nearly 1,700 members of the Sons of Confederate Veterans who legally purchased such plates and are exercising their First Amendment rights,” Taylor said in a statement. He added that he expected members to “wholeheartedly challenge” a recall.

Kiser ruled the specialty plates issued by the state represent government speech, not protected free speech, and are therefore subject to regulation.

A spokesman for Attorney General Mark Herring deferred to the DMV on the mechanics of license recall. As for the prospect of a legal challenge, Michael Kelly wrote in an email Saturday that “we certainly hope this can be a cooperative and collaborative process to implement Judge Kiser’s ruling and the law passed by the General Assembly” ...
