GOP fears it will win ObamaCare court battle
By Alexander Bolton
Republicans in Congress are worried the Supreme Court will hand them a major headache this month if it rules against the federal health insurance exchanges in more than 30 states, ending subsidies for millions of people.

(25,224 posts)If they fear they will win - they lose. Can they cut there losses by withdrawing this case from SCOTUS? Just make it go away and let ACA stand as it was intended to be interpreted.

(10,621 posts)Legislative intent could not be any more clear.
Ruling to strip those subsidies would completely de-legitimize the current Supreme Court. It would be senseless, after that, for Democratic leaning attorneys and judges to give their pronouncements any more consideration at all.
The Supreme Court doesn't have an army or a police force. The only real power it has is the willingness of lower courts to follow the precedents it sets.
But if it is nothing more than a branch of the Republican Party, to Hell with that.
