Birthers Lack Standing to Fight Obama, Court Says


(CN) - The 9th Circuit doomed another challenge to President Barack Obama's citizenship on Thursday, finding that none of the so-called birthers could show an actual injury.

Including active members of the military, state-level elected officials, an alleged member of Obama's family and former presidential candidate Alan Keyes, the plaintiffs claimed in a 2009 lawsuit that Obama was ineligible to be president because he was not a U.S. citizen.

U.S. District Judge David Carter dismissed the complaint in California after finding that none of the plaintiffs had standing to sue. A three-judge panel of the federal appeals court affirmed unanimously from Pasadena on Thursday.

Lt. Jason Freese, an active military plaintiff, argued that he and other soldiers could show injury because he "would face disciplinary action by the military" if he or other soldiers were to "refuse to follow President Obama's orders, despite his ineligibility for the presidency," according to the ruling.

He desegregated the military in 1948. Yet, you're listed as a plaintiff on this lawsuit contending the place of President Obama's birth. You DO realize that, being a plaintiff on a lawsuit born out of racism (there has been NO credible evidence that disputes President Obama's assertion that he was born in Hawaii in 1961), you no longer have the moral authority to proclaim or even CELEBRATE any of President Truman's achievements.

Please remove the picture of President Truman from your website or I will be in contact with his heirs. I'm reasonably certain they would NOT be approving of President Truman's image on the website of a racist.

5. Interesting. I wonder if anyone could ever have standing to bring a suit such as this. And if not,

does that mean the constitutional requirement is unenforcable if we did ever have a president who turned out not to be a natural-born citizen.

I'm pretty sure you don't have to prove you're a natural born citizen to get on the ballot, so it stands to reason that an ineligible person could get themselves elected prez one day.

If that happened, who would be injured and what would their injury be?

I was involved in a civil suit against a local government in Florida and they tried to toss me out for lack of standing because I hadn't been injured (yet). They didn't get it done, but it was the same thing that happened in this case.
