The judge described the crime as "mystifying," considering that Mr. Winckler earned $260,000 a year and also earned a $1.2 million bonus when the company was sold in 2011.

He whined about the expenses of taking care of his autistic son but the judge wasn't buying that shit!

The judge ordered him to pay full restitution, including $1 million to the IRS. Winckler had pleaded guilty to conspiracy, mail fraud and filing false income tax returns.

He apologized to the judge, to Falcon Drilling, its employees and owner Ted Kozel, saying he was ashamed of what he'd done. He asked for leniency in part because he said he had struggled to care for his autistic son, but he admitted that he had also "spent too much time in the casino."

The judge noted that he didn't spend his ill-gotten gains on treatment for his son but instead used the money on luxury items and real estate, all of which has been forfeited to the U.S. Winckler was the COO of Falcon from 2004 through 2012.

Assistant U.S. Attorney Greg Melucci said he forged checks to steal funds and then forged invoices to cover the thefts systematically over many years in complete disregard for anyone at the company or their families. He described Winckler as an "uncontrollable train" of embezzlement, fleecing his company with "enormous selfish acts" despite the fact that he already had an excellent income and provided well for his family.



The Trib-Review report has more interesting details. This A-hole blamed not only his theft of more than $9 million, but also his drinking and gambling on the fact that one of his sons was diagnosed with autism.


A former Indiana County gas drilling company executive said Friday he started stealing from his employer in 2004 after one of his sons was diagnosed with severe autism. “I started to drink and gamble,” said Larry Winckler, 54, of Indiana. Over the next eight years, he stole more than $9 million from Falcon Drilling LLC, where he was the chief operating officer.

Winckler pleaded guilty in February 2014 to conspiracy, three counts of mail fraud and three counts of filing false income tax returns.

U.S. District Judge Terrence McVerry noted that Winckler used the money to gamble and buy luxury items rather than using it to pay his son's medical bills. He sentenced Winckler to eight years in prison, four years of probation and ordered him to pay more than $10 million in restitution to Falcon Drilling and the Internal Revenue Service.


He also ordered Winckler to forfeit several luxury items including four Rolex watches, a Mickey Mouse diamond necklace, a Hello Kitty diamond necklace, clutch purse, figurine and what the judge described as a hunting and fishing enclave in Clearfield County.
