ALABASTER Officer Joshua Herbinger has been working as a police officer for nine years.
On October 9, 2014 he was charged with sexually abusing a child less than the age of 12. He received four counts of sexual abuse, according to reports.
The child had been attending an elementary school and reported the molestation to the school staff."
According to the child, Officer Herbinger molested the child over a period of two to three years."
Officer Herbinger was never fired, and was granted administrative duties with pay.
Officer Herbinger was set free after posting $80,000 bail.
It didnt take long after his release for Officer Herbinger to be caught again.
This time he has been charged with first-degree rape of a woman"

Tyler Smith, 18, was arrested last month and faces two counts of rape from an incident alleged to have happened during the summer, and another in 2012, according to court documents.

High school kid is in no position of power or authority like an LEO.

Frankly, I think they're both likely guilty, but that wasn't the point. The point is should the cop be fired or the kid kicked out of school before trial? With the cop on desk duty I'm not seeing a problem with his keeping his job, and I don't like anyone getting fired before being found guilty or not. I also wouldn't like the kid being thrown out of school for the same reason.
PERSONALLY, I'd be more comfortable not being even in the same neighborhood as either one of them, and sure wouldn't want to have to work with the cop or go to school with the teen. And that's because I think both are probably guilty or at least what they're accused of has me so grossed out I'd never be able to be in the same room with them just being worried that they ARE guilty.
But what if neither one ARE guilty? Should anyone lose their job because of something they didn't actually do or get thrown out of school for something they didn't actually do? I don't think it's appropriate to just assume that someone is guilty to the point of actually making them suffer real consequences for that assumption by firing them or kicking them out of school. Neither one is legally guilty of anything until a jury says so, so legally should either one suffer real consequences based on just being charged with a crime that no one yet knows whether they're guilty of or not? The cop is on desk duty, and the teen voluntarily took himself out of the football program, but they're both out on bail and should be able to reasonably resume their lives until trial. Whatever I feel about either one personally shouldn't be in consideration nor should it be to anyone else. And it's not at all easy for me to say that especially when it comes to rape and more especially the rape of a child.
