Arrested Again

Arrested AgainGeorge Zimmerman is still playing with guns. Zimmerman was taken into custody following another gun incident in Central Florida. This incident involves his wife and father-in-law, Colin Morgan and occurred at the parents of Shellie Zimmerman’s home; his estranged wife.

Police in Lake Mary County were called to the home on Sprucewood Road following a report received on Monday afternoon concerning an altercation which involves Zimmerman. The Police are still trying to conclude what exactly took place.

Shellie’s attorney, Kelly Sims, told ABC News that Zimmerman pulled a knife on her after she found a gun in the house they shared. He then pulled a firearm on her and her father after a verbal altercation went sour.

Sometimes not pressing charges is done out of fear of retribution, which is one of the reasons DAs can proceed without the complaint.

I'm not surprised at this development, it happens more often than not.

Looks like a 10 year mandatory minimum sentence in Floriday, and only the prosecutor can waive the minimum sentence... not a judge.

Aggravated Assault with a Firearm

Under Florida law, the criminal offense of misdemeanor assault alleges that the defendant committed an act that threaten imminent violence. If a weapon is used, the charge is the the criminal offense of felony aggravated assault. If the offense charged is Aggravated Assault with a Firearm, under Florida Statute Section 784.021, the following elements must be proven beyond all reasonable doubt:

-The defendant unlawfully and intentionally threatened another person by saying or doing something.
-At a time that the defendant made the threat he appeared to have the ability to carry out the threat.
-The act of the defendant caused the alleged victim to have a well-founded fear that the violence was about to take place.
-The defendant used a firearm by pointing the firearm at the victim in a manner which threatened to use the weapon in a way likely to produce death or great bodily harm; and
-The defendant had a fully-formed, conscious intent to commit the aggravated assault with a firearm upon the alleged victim.

The prosecution is not required to prove that the defendant intended to kill anyone under Florida law. An aggravated assault is a third degree felony punishable by five (5) years in Florida State Prison and a $5,000 fine. If the assault involved the actual possession of a firearm, then the offense also carries with it a three (3) year minimum mandatory prison sentence, meaning that if you are convicted, the court must sentence you to at least three (3) years in Florida State Prison.

Florida aggravated assault occurs when a deadly weapon is used without the intent to kills but with an intent to commit a felony. Lesser included offenses include improper exhibition of a dangerous weapon or firearm under Florida Statute 790.01, and discharging firearms in public under Florida Statutes 790.15.

However, Lake Mary police Chief Steve Bracknell confirmed about 4:30 p.m. that Shellie Zimmerman and her father, David Dean, had signed paperwork declining to press charges.

"They both have declined to press charges against George," Bracknell said. "We have no victim, no crime."

The Fourth District Court of Appeal stated back in 1999 that the "decision to prosecute does not lie with the [alleged] victim of the crime." State v. Wheeler, 745 So.2d 1094 (Fla. 4th DCA 1999).

Rights of the "Victim" are cast aside.

When the State Attorney's Office files charges against a person accusing them of domestic violence they must list a victim to prove their case. The legislature has given alleged "victims" of crime many statutory rights found in Chapter 960 of the Florida Statutes. Among these rights, which we will get to in a moment, is the legal definition of a victim = "any person who suffers personal physical injury or death as a direct result of a crime." Crimes are defined by the criminal statutes but whether a person has suffered a personal physical injury is (or should be) defined by the alleged victim!

For example, a couple that routinely expresses themselves by abrupt physical contact (like the way Elaine on the TV show Seinfeld routinely shoved other characters and said "get out!&quot are not committing crimes against each other even though such an act has all the elements of a battery.

When the State files a charge of domestic violence the victim has specific statutory rights. Among these are the statutory right to be present at all proceedings and hearings relating to (1) the arrest of the accused, (2) the release or modification of release conditions of the accused pending judicial proceedings, (3) and the prosecution of the accused.

Additionally the victim has a right to express views about the (1) release of the accused pending judicial proceedings, (2) any plea agreement, (3) participation in pretrial diversion programs, and (4) sentencing of the accused.


So what happens when the "victim" expresses the view that she does not want to testify or prosecute the case against the accused? Often the victim's expression is ignored - even when the alleged victim's expression indicates that she is not a victim of a crime.

It's painfully plain to anyone who's worked with domestic violence survivors what their marriage is probably like. Sad that it was never brought to the jury's attention in the Martin trial - Z is obviously an insecure bully with a bad temper & delusions of grandeur.

I don't trust either one, but SZ doesn't appear to be as dangerous as GZ.

Freepers are threatened by black men, and many of they have had issues with women in their past.

If you listen to any right wing talk radio station you notice during that most of the commercials are for: gun shops, male enhancement pills, divorce/DUI lawyers, and men's rights advocates. Station owners know their audience, and their audience strongly identifies with GZ, for the reasons I mentioned.
