In an unusual move, Virginia Attorney General Ken Cuccinelli II (R), his party’s nominee for governor, launched a new campaign website Wednesday highlighting his efforts to reinstate Virginia’s unconstitutional Crimes Against Nature law. The rule, which makes felons out of even consenting married couples who engage in oral or anal sex in the privacy of their own homes, was struck down by federal courts after Cuccinelli blocked efforts to bring it in line with the Supreme Court’s 2003 Lawrence v. Texas ruling.

The new site, vachildpredators.com, highlights 90 people identified “sexual predators” in Virginia who have been charged under the law since the 2003 ruling, which held that states could not ban private, non-commercial sexual relations between consenting adults. Cuccinelli warns that these offenders “could come off Virginia’s sex offender registry if a Virginia law used to protect children is not upheld,” and identifies the sodomy law as only the “Anti-Child Predators Law.” While it is true that many sex offenders are charged under the Crimes Against Nature law, it is far from the only tool prosecutors have to punish child predators.

The law states, “If any person carnally knows in any manner any brute animal, or carnally knows any male or female person by the anus or by or with the mouth, or voluntarily submits to such carnal knowledge, he or she shall be guilty of a Class 6 felony…” Cuccinelli claims that the law “is only applied to sodomy committed against minors, against non-consenting adults, or in public,” but fails to mention that what he wants to keep on the books criminalizes the private behavior of consenting grownups.

But Williams’ ties to top Virginia Republicans go back further than the current administration. Williams and his company, Star Scientific, gave heavily to the 2005 gubernatorial campaign of Republican Jerry Kilgore. Kilgore, who served as Virginia’s attorney general from 2002 to 2005, lost to Democrat Tim Kaine. Currently a partner at the law firm McGuireWoods, Kilgore now serves as Williams’ attorney, and has acted as his spokesperson during the current scandal.


I'm fairly sure McDonnell will do whatever he has to to not go to jail.

That same year, Cuccinelli disclosed receiving a gift valued at $800 for a temporary stay at the Goochland County residence of Jonnie R. Williams, the chief executive of a Glen Allen-based health supplement company. Cuccinelli's relationship with Williams, whose Star Scientific Inc. firm once marketed tobacco products, appears to evolve from there, according to records.

His staff said the attorney general acquired company stock in 2010, and the year after, when he also reported accepting nearly $13,000 in gifts from Williams.

More than a year after Cuccinelli's e-cigarette opinion, Williams, whose company is behind the smoking-cessation dietary supplement CigRx, filed a patent application for an "alkaloid composition for an e-cigarette." (snip)


In recent weeks, the attorney general and presumptive Republican nominee for governor this year has found himself facing conflict-of-interest questions over his ties to a firm suing the state over a disputed $707,590 tax bill from over a decade ago. (snip)

Data compiled by the Virginia Public Access Project show Williams gave Cuccinelli $12,965 in reportable gifts in 2011 - the year Star Scientific sued the state over the tax assessment. That sum covered three gifts: a box of food supplements valued at $6,711, $3,254 for transportation to a meeting, and $3,000 for the use of a lake house and boat.

In addition to those ties to Williams, Cuccinelli owns Star Scientific company stock. Cuccinelli campaign adviser Chris LaCivita said the attorney general acquired his first batch of stock, some 5,060 shares worth roughly $10,000, in October 2010, then more shares the following September.

His stake in the publicly traded company wasn't disclosed until last year when he amended his state economic disclosure, as required in Virginia, to reflect an investment in Star Scientific worth more than $10,000.


Cuccinelli is in just as deep as the Governor and former Attorney
General

The Court held that intimate consensual sexual conduct was part of the liberty protected by substantive due process under the Fourteenth Amendment. Lawrence invalidated similar laws throughout the United States that criminalized sodomy between consenting adults acting in private, whatever the sex of the participants.[2]

why not encourage the legislator to draft laws specifically aimed at child predators. Don't use child predators and protecting children as an excuse to round up and charge homosexuals with a felony.

In fact, Cuccinelli is a major reason that the provisions of this particular law governing non-consensual sex were left vulnerable to court challenge. In 2004, a bipartisan group in the Virginia General Assembly backed a bill that would have brought the law in line with the Supreme Court’s ruling. They proposed to eliminate the Crimes Against Nature law’s provisions dealing with consenting adults in private and leaving in place provisions relating to prostitution, public sex, and those other than consenting adults. Cuccinelli opposed the bill in committee and helped kill it on the Senate floor.

In 2009, he told a newspaper why he supported restrictions on the sexual behavior of consenting adults: “My view is that homosexual acts, not homosexuality, but homosexual acts are wrong. They’re intrinsically wrong. And I think in a natural law based country it’s appropriate to have policies that reflect that. … They don’t comport with natural law.” As a result of Cuccinelli’s homophobia, the law’s text remains unchanged a decade after the Supreme Court’s ruling.

110. I'm sure the aim is to use this law to outlaw homosexuality, but times have changed...

...if they tried to convict only homosexuals under this law, it would immediately go to court and they'd either have to charge heterosexuals or have it cut down. I mean, what difference does it make if a woman is giving a man oral sex or a man is giving a man oral sex? If oral sex is against the law, both have to be charged (and do you charge both or only the one giving? ).

So this candidate is going to have a much harder time getting elected on this because heterosexuals will suspect they are at risk from this law, not safe from it (and on board with it being used to persecute gays) as was the way in the past.

The one good thing about these hard right Republicans is that they are so far out of it that they cannot keep themselves from doing stupid stuff like this. I mean....anyone with a bare minimum of political instincts would know that a candidate crusading against oral sex will be painted as a guy who is hopelessly out of the mainstream. It's time to call bullshit on Cuccinelli's latest claim. He says he needs to have the US Supreme Court re-institute Virginia's law against consensual anal and oral sex between adults because a middle aged guy once asked a 17 year old girl for a BJ.

Yesterday, he put together a new website that lists 90 sex offenders who (he says) will not be required to be identified on the sexual offender website unless the state "crimes against nature" law is upheld.

I just checked out a couple of those names. One is still in prison. For several, there was little information online. Another was convicted of "rape and forced sodomy." That is the whole point - if a person is underage or there is any type of coercion, that is a completely different story, and those actions are already outlawed.

Back in 2009 this man was the a State Senator from Fairfax County and somehow he ran and won the Attorney General office in Virginia. Elections have consquences and this guy in panderering to the God, Guns, Jesus and antigay crowd that hangs out in the spine of the state that runs from Winchester to Bristol. He is counting on Democrats not getting out to vote in a what is an off year election. Cuccinelli is a very scary man who firmly beleives he is answering to a higher calling. This man makes Governor McDonnell look like a flaming liberal, if elected he will turn Virginia into the Kansas of the east because the Va house is firmly in republican control and the Senate is split equally and they are all up for reelection this year. As a native Virginian it baffles me how stupid people in this state can be when in comes to state elections. THis race will be far closer then people want it to be.
