And I don't think it should. According to the courts, he was acting in self defense. Trying him for another crime would violate his right against double jeopardy. Even if you want to see him guilty, it doesn't justify throwing the constitution out the window.

State tried Nichols for the 161 other people murdered for which the feds did NOT prosecute him.

They did it a few times in the '60s after Klan members got by with murder in state courts.

Different jurisdiction and different charges if it goes to the Federal Courts.

By the way, I really think that persecuting those that need medical marijuana is as low as what Republicans do. You Holder apologists tell me why he relishes denying medical marijuana patients their medicine. Evil, that's what I say.
