Executive order issued Jan. 20, 2025: "Within 90 days of the date of this proclamation [deadline: April 20, 2025], the Secretary of Defense and the Secretary of Homeland Security shall submit a joint report to the President about the conditions at the southern border of the United States and any recommendations regarding additional actions that may be necessary to obtain complete operational control of the southern border, including whether to invoke the Insurrection Act of 1807."

He can claim this all he wants, but there simply aren't enough cops.

(2,783 posts)It would be illegal and un-constitutional, the Insurrection Act would be neither authorization nor justification.
But Trump doesnt care about the Constitution or law, and will again ignore the Supreme Court.
It will then depend on how the states and military respond.

The Constitution of the United States does not define martial law and is silent as to who can impose it. However, the modern interpretation allows the president and state officials to declare "degrees of martial law in specific circumstances."
