I'm afraid I have to be the bearer of some very bad news about The Magistrate

We have received word from the family of The Magistrate that he has had a sudden and devastating heart attack. I've been asked to post the following on behalf of his family:

The Magistrate has had his last heart attack.

This week, days after seeing his cardiologist (who gave him a clean bill of health), The Magistrate had a severe heart attack that doctors say would result in permanent brain damage. He is totally unresponsive and will not survive. Tomorrow doctors will remove him from the respirator. Our extended family will be there along with friends.

DUers have been so generous in the past with their tributes and best wishes that the family would love to read the replies at the funeral. Please post your condolences and memories of James, aka Papa, aka The Magistrate, a kind, caring, funny, very very smart and loyal man who was considered very special by everyone who knew him. We will miss him forever.


The Magistrate has been a fixture on Democratic Underground for nearly 23 years, almost since the beginning. He joined in October of 2001, less than a year after the site was founded, and his sardonic wit and playful, unique posting style quickly made him a favorite of many DUers -- and occasionally drew the ire of others.

But as much as he sometimes raised the hackles of the folks with whom he loved to verbally joust -- and he wouldn't have had it any other way -- nobody could ever claim that The Magistrate did not care about this country and its future.

Sir, you were a great Democrat, and a great DUer, and you will be greatly missed.

I always regarded him with awe. I can't remember if we ever spoke to one another, but I know I read many of his remarks. He was always courtly and courteous!

Your beautiful eulogy brought the sting of tears. Thank you for sharing this very sad news.

Whenever I saw one of his posts, I read it very eagerly, knowing what he wrote was going to be both brilliant and accurate, as well as witty. Every post he made, always made me think more deeply about the issues, and informed me.

I was sad to learn of his passing. I will miss his wisdom.

I was always so proud when he would respond to a post of mine. He has such grace and wit and I'm devastated I'll never see a post with his familiar "Ma'am".

I want his family and friends to understand how much we all love his presence here and he'll be leaving a hole that can't be filled.

The sudden shock is heartbreaking to experience. He was a presence here and we will miss him.

This is what terrifies me about going to my cardiologist. My mother had a stress test, and then got a clean bill of health the day before she dropped dead of a heart attack in front of me. It happens more than people realize. A good reason to always tell your people you love them.

I hadn't heard from her for awhile. Was wondering if she unfriended me. So, I went to her page, "We miss you". She died suddenly and had posted several times on the day she died. I don't know how she died, but I assume it was a sudden heart attack or something similar.

my mom's cousin's wife had gotten a clean bill of health. soon after she died while being treated after not feeling well.

That Friday, she flew back to Detroit to oversee settling her mother in the nursing home they had chosen. She woke up the next morning, told her son, with whom she was staying while everything was settled, that she wasn't feeling well. Twenty minutes later, she was dead from a massive coronary. She was slender, non-smoker, casual drinker, upbeat, grrat sense of humour. No indications or markers at all.

The Magistrate and I did not always agree on the remedy for the 1/6 insurrectionists. I was much more emotional than he. He lived up to his name, the Magistrate. He was reasoned and logical like good judge would be. He helped to ground me and keep me on the strait and narrow. I will miss his honest and direct assessment. I feel especially devastated that there were no obvious signs that might have forewarned his cardiologist, and somehow led to the prevention of this horrible outcome. That only makes the news more heart-wrenching--even while I know it happens-- no matter how good the care.

As a fellow member here from the beginning with The Magistrate, I can echo those who reference his intelligence, eloquence, broad understanding of issues, and curiosity for those he was learning anew. His posts could always be identified immediately by his preferred use of "sir" in each and every one. I shall remember him fondly for a lot of things, but always with that mandatory emblem of respect.

DU will never be the same without you, but you, sir, will be remembered. RIP

I worked closely with The Magistrate when I joined him in moderating the Israeli/Palestinian Forum at Jack Rabbit's retirement. The I/P forum at the time was unlike any other forum and prone to intense and personal flame wars between the various members. The topics and nuances of the situation required not only expertise but also the patience of Job. James was all of that and more. He was always fair, and no matter how heated the thread was, even if it was personally directed, he maintained a high standard and a sense of decorum.

Like me, he was a long-time student of military history and was very familiar with the many conflicts in the world over time. His passion for aircraft modeling was well-regarded by those in the hobby industry. We had many wonderful conversations about history and living in the 1970s. We talked about our personal lives and grew as friends. He always was a gentleman and a scholar. I am sad I never had the opportunity to meet him in person.

He and I used to quote an old military expression from the Philippine-American wars around 1900 about officers who served on the island of Samar during the fiercest of the campaigns. The allusion refers to the I/P forum.

Please stand for my friend James, "He served on Samar." Pass the bottle saved as a tontine and drink slowly and deeply to a gentleman, scholar, and true bohemian in life. May his memory serve as a blessing.

The Magistrate greeted me when I was new to DU in 2002. My handle was “Oblomov” and he reminded me to delete the address information on my profile. Later I changed to Octafish. In every single post, interaction and discussion with The Magistrate, including a few where we might have disagreed on a subject, was an enlightening experience.

I was introduced to the reading of one of my very favorite authors, ‘Saki’ (H. H. Munro) by The Magistrate. Which has become a cherished source of my inspiration ever since.

Please, Magistrate, go swiftly to a better place. You will be sorely missed in this one.

This sad and devastating news brings deep bereavement. He was always there to support his fellow DUers with kindness and wit, often defending them during contentious discussions. He was there for me on many occasions. The Magistrate saw things the way they were rather than how he wished they would be. His loss will be felt deeply by many who considered him a friend. I will miss him deeply.
In real life, it must have been a joy to know him.
May his memory forever be a blessing.

With his Confucian sig-line and playful-formal Confucian persona — he brought out a joyful Taoist in me, and I’m not usually a happy person when it comes to politics.

When I replied to him as Sir, I always wished for a little emoji that was making a formal hands-in-sleeves bow.

The Magistrate lost a lot of his lightness when his son passed away, but was still our sage with the formal air.

I weep as I write this, Oh Sir, please don’t go yet. Yet if there is anything we learn as we age, it’s that we all must go in our time.

Come, Sir, let us sit by the river, recite poetry, and drink wine, and float our empty cups away in the moonlight.

Please know that our hearts and love and sorrow go out to all of you in this grievous loss. The Magistrate, as we knew him, is a tremendous loss to all of us here on DU. I remember encountering his posts when I first came to DU, months before I actually joined. From the first, I delighted in his formal, wickedly smart, often brutally ascerbic and funny, comments. His posts, amoung others, let me know that I had truly found my home in DU, and that has not changed in almost 22 years.

Please know that, just as James is/was part of our DU family, so, too, are all of you. We are here for you.

The Magistrate selected such a perfect username, adopting a 'magisterial' tone in his postings.

The sigline he chose: "When things are not called by their right names, what is said cannot make sense. When what is said does not make sense, what is planned cannot succeed. When plans do not succeed, people become uneasy. When people are uneasy, punishments do not fit crimes. When punishments do not fit crimes, people cannot know where to put hand or foot." revealed his commitment to clarity, quality of communication, and community-building.

He was one of the earliest posters I remember engaging with regularly, and I was always secretly quite chuffed when he posted an accolade in response to one of my posts. His breadth of knowledge and the depth of thought and analysis he brought to many discussions truly enriched the quality of interaction here.

I am not surprised to learn his real-world family and community knew him as a "kind, caring, funny, very very smart and loyal man who was considered very special by everyone who knew him". He was all that and more, here, and I will miss him greatly.

The Magistrate has definitely been a fixture here at DU over so many years. I remember his courtly, impeccably polite replies to everyone he encountered. I always felt that he was someone who was willing to listen to my opinions -- which are not popular -- with an open mind and sometimes an open heart, which is all I can ask for online. And when I disagreed with him, I had only respect for him; never contempt. We also had a DM conversation that was one of the most gracious I have ever had on the internet with anyone. I am so, so sorry to hear this news and his family is in my thoughts.

The Magistrate (or James, as he’s now been revealed to us) has been a DU stalwart for almost 23 years. He’s always been a part of my DU, since I joined the group three months after he. What a force he has been within this community!

His prose was impeccable, his passion and intellect formidable in equal measure, his sly sense of humor devious and occasionally devastating. He certainly kept us on our toes by setting a consistently high bar for those of us who strive to think and write as well as he did.

I would be lying if I said I always agreed with him — and I know he would not want any of us to pretend otherwise — but I can honestly say that his arguments were always bolstered with a deep knowledge of history and culture, thoughtfully reasoned, and quite artfully expressed. No one could accuse him of anything less than 100 percent loyalty to the Democratic Party and the profoundly human values it represents.

I had very few direct interactions with him, although I always read his posts, because I considered him one of the DU members whose ideas and opinions were consequential. As much as it pains me to admit it, he caused me to change my mind a few times, or at least to soften some of my perspectives.

I remember when The Magistrate reported that he’d be away for a while after his son unexpectedly keeled over dead. The father of two myself, I have some sense of the anguish that such a loss brings — although only the parent who’s lost a beloved child can truly know that kind of grief. And now James’s family has to find the strength to bear another unbearable loss.

I hope his family and friends will find some solace in knowing that he had much love and respect from this cantankerous community of unlikely allies, and his influence will long linger.

I was lucky to meet The Magistrate a few times. He was not what I expected, but the minute he walked into the restaurant we all knew it was him.

Though I never knew his educational level, The Magistrate has to be one of the most widely read people I've ever known. There was nothing that he could not -- or would not --discuss with great intelligence. I served with him as a moderator years ago. He was a big help to me in learning the ins and outs.

This is a lovely tribute to him. As you say, he was a great Democrat and a great DUer. I'll miss him.

I loved him and looked for him and thought about him often. I always giggled when I had to address him as The Magistrate. I loved his 2 cents. I mourned with everyone when he lost his son. I will miss him.

the same that same thing happened to a close friend of my parents. The kind of friends that you call them aunt, and uncle. Given clean bill of health by doctor. Went out to play tennis, and dropped dead.

I will never forget my exchanges with The Magistrate from 2004 forward. The fact that we always seemed to agree might have been due to his consistent graciousness, or our shared brilliance.

If I'd ever been asked, "Which DUer would you most like to converse with in person?" it would surely have been The Magistrate.

Although I haven't been around DU much for the last 5-10 years, The Magistrate stays in my memories!

Brilliant, of course. Measured. Humane, enlightened, witty, wise. He always brought us the opportunity to rise to his level. I valued his presence here and will miss him.

I’ve been reading the comments on this and other threads and even though I haven’t had much interaction with him, I’m in awe of the many lives he touched with his kindness with words and respect for others. I’ve learned so much about him and wish I had the pleasure of his friendship as so many here have. My condolences 💐

they say you can't choose your family but the magistrate chose us--to be a part of our DU family (as we all have)

may his spirit be delighted from his reunion with loved ones who have gone before.

I’ve been here for 20 years and served multiple times as moderator with him, and enjoyed reading most of his opinions over the years. I will miss his almost daily presence in my life. Sending comfort to his loved ones. May his memory be a blessing.

It is so huge of a loss. Through the window of being moderators at the same time back in the earlier years, he taught me a lot.

I am deeply sorrowed by this news. It will take some mulling over, some thoughtful consideration of his decades of words on this site, to come to terms with this news. But his impact on DU was enormous, and positive.

Enjoy life beyond time, Magistrate. And thank you.

Not The Magistrate!
He was one of my favorite DU members. I loved every one of his posts. He was truly a shining light in a world that was sometimes filled with far too much darkness.

Maybe someone can start a tribute thread where we can share links to our favorite Magistrate posts?

I’m so sorry to hear this. The Magistrate has always been there to offer wisdom and perspective. We are all the poorer for losing him but all the richer for having his posts to read and ponder. He always made me feel like sitting up straight, with head held high and eyes and ears wide open, and hopefully, mind wide open, too.

Safe passage, sir. Thanks for being here to share this crazy journey with all of us. Your take on things has never failed to enlighten, while helping us stay well-grounded, even if it’s to a reality that we sometimes didn’t like. We’re all better, smarter, and wiser thanks to you.
