during the day?
I've heard it speculated that trump is itching for Merchan to charge him for breaking the gag order by imprisoning him, and that Merchan doesn't want to imprison him for the customary 30 days because he doesn't want to delay the trial by not having trump present. But can't Merchan make trump stay overnight in jail for the duration of the trial without delaying anything?

(5,860 posts)But someone who was interviewed said he could impose a sentence and have TFG report to jail after the trial. If he keeps violating the Gag Order, just add more to time.

(8,937 posts)to break the gag order. He wouldn't be able to do that if he was in jail all night. At least, not as effectively as if he was out as a free man.

(5,860 posts)On the other hand, if a sentence is ordered and he knows it is coming, as opposed to a big maybe and only if convicted, perhaps a light bulb will go on. He will lose a lot more campaign time if the trial time is followed by time in jail for contempt

(44,088 posts)It's the maximum. That doesn't make it customary. But what is customary: judges not imposing a prison sentence when the DA only has asked for the penalty to be a fine. Which is where we are at present.

(2,332 posts)But having someone in jail but being brought into court when necessary is SOP for someone charged with contempt, or, well, for anyone who's serving time for another crime but is required to be in court for whatever reason, either as the accused or a witness. Even if you're in jail, you can be brought into court if called.
Happens all the time.

(12,064 posts)I don't want to see or hear that his aide brought him food. He eats jail food only! And he goes back to waiting cell during breaks and lunch, no having his cell phone with lawyers. To me that wouldn't be punishment.

(5,553 posts)He knows Trump and his protection detail would destroy the jail's routine and turning to chaos. Regardless of what people here think he can't be treated like just another detainee.

(8,937 posts)That might be all he cares about initially. But after a month or more of spending the nights/lunches/breaks in jail, it would wear anyone down. So while there might be some upside benefit for him, I'm pretty sure the novelty of it would wear off mighty quickly.
There's not enough money in the whole world that would have me enjoying being in jail or in a courtroom 24/7 for a month or more. Plus, I'd love him to see and experience some of what Allen Weisselberg is going through.
