Then scotus will likely decline to hear the case.
There is really nothing they need to decide. This theory doesn't appear in the constitution or federal case law, and is invented solely as a distraction.
It has been dealt with at the appellate level. Moreso if they go the en banc route and get a 9-0 shut down.

The opinion appears to be written to facilitate denial of cert by both.
Trump has until February 12 to file appeal for en banc, or stay is lifted.
EDIT: just read that stay will be lifted unless Trump appeals directly to SCOTUS, so guessing he will skip the en banc step.

They cant rule on an appeal that hasnt been presented yet. Lets just hope when they do get it, its a quick decision.
