I assume that much, if not all, of the settlement will be paid from insurance
Corporations typically carry both general liability insurance as well as errors and omissions coverage. The latter is used to protect not only the corporation, but individually its board members and executives. I would love to know how much of the settlement Faux's corporate insurance is paying.
When Smartmatic gets through with them, it will be the time for ambulance chasers to start going after them for the individuals that have been harmed by Fox's lies.
Time limits. But aside from that corporations can sue because they can afford the enormous legal fees. Individuals can't afford to put out that much money in advance and lawyers will not take them on a contingency because there is too much risk.
Fox just gave away nearly a billion dollars of their money!
...it is possible insurance won't pay. It was not an honest error. If you know your house has a structural issue that could cause collapse in high winds, and you do nothing about it and a wind storm knocks the house over, most insurers can walk away without paying.

as if some slipped and fell on your icy sidewalk. What they won't cover is most intentional torts, like if you beat someone up. Since Fox's defamation of Dominion was clearly intentional and knowing, I am wondering whether their business liability insurance will cover it. They might have specific coverage for it, though.
Liability they have and how many policies it will be spread across
It is very possible insurance will pay it all
as defamation insurance coverage for media outlets. If anybody needs defamation coverage it would be Fox.
