Gag Trump

There are two ways to know when Trump writes things, or posts what one of his employees wrote for him. First, the real Donald can't spell very well at all. Perhaps in time he will learn to spell Justice Merchan's name. I wouldn't bet on it.

The second way is when it is within a plattering of other posts that reek of panic. We all remember his behaviors leading up to January 6. Or recent rants about violence if he is indicted. One might be safe in anticipating he will attempt to have a large crowd outside of the DA's office and courthouse next Tuesday. For that is his cowardly nature to try to threat and intimidate -- in effect, saying if he is held responsible, others will inflict violent retribution.

Thus, it is my hope that DA Alvin Bragg and Justice Merchan agree on Tuesday that there should be a gag order on Trump. It's not that I am anti-Amendment 1. It is because I know that Trump would be incapable of following any such order.

Now, generally judges make an effort not to issue a gag order. Issues relating to them have been the stuff of numerous very important cases when they are appealed. But it is pretty well established when -- in criminal or civil cases -- a judge can correctly issue one. Let's look at this:

"A judge might implement a gag order for a multitude of reasons but primarily for the safety of others and the overall outcome of the trial. The judge’s goal, ideally, is to make sure that every party is treated fairly and is held to the same standards under the law. A gag order is used to prevent the scales of justice from being tipped in one direction or another

Immediately, one thinks of Roger Stone's most recent case, including his violations of the gag order. We remember that Roger was eventually pardoned by his friend, so that he could freely assist in organizing the attempted overthrow of the federal government. Again, another attempt to threaten and intimidate.

Justice Oliver Wendall Holmes famously noted that you can't yell fire in a crowded theater. That illustrates the idea of limitations on Amendment 1. What is too often overlooked is that it had to do with a fellow attempting to convince fellow citizens to oppose the draft. He was charged with espionage, in an interesting case.

It is more than evident that Trump is trying to light fires. If there is a gag order issued, he will definitely have a melt-down, ignore his lawyers' advice, and splatter more out of control posts. Then, he will have confirmation that he is in no sense in control of the court.

I do not expect any significant number of idiots to show up Tuesday. The police are fully prepared to handle any "crowd" that might be there. And, as others have noted, those who might have planned violence are presently incarcerated for January 6 activities. There have been preparations made to keep the access routes to the DA's office and court clear and safe, too, after monitoring some anti-social media after Trump's "I'm getting arrested on Tuesday" bleat.

these Trump Misfits are not stupid enough to again bring a crowd........With 2K cops, and thousands more behind them, these assholes won't be so lucky as to be allowed to just wander off like the last bunch when they are shut down.......

And this time around, these Trumphumpers will be dealing with some really serious cops, unlike some of the Trump loving members of the Capitol Police and DC Police, and they will be more than willing to use force vs force as needed.......
I can't imagine the NY cops allowing for any person brandishing a weapon like they were all allowed on J6th

I'm 100% in favor a gag order, BUT it has to be 100% enforced, and THAT is the problem.

one way it can be enforced, and that is by the judge. You raise a good point, of course, as the judge in the Stone example failed to use the available options.

I would begin by first setting boundaries right off the bat. First violation, $50,000.00 fine. 2nd violation, $100,000.00 fine, plus loss of ALL social media usage. (including getting other persons to do it for you) 3rd violation straight to jail. Just so he understands up front, what's on the line here!

The judge might recognize that Trump would use any fines for fund-raising. I would consider firmer consequences. If he violated those, I'd think jail would be necessary.

Keep him locked up for a while, while they argue whether he should get bail. After all, he is a flight risk, and has made threats repeatedly.

If he were anybody else, do you think they would let him out on bond?

Uh, Donald, wasn't Michael Cohen indicted, convicted, and imprisoned for that very same crime?

I don't think The Loser Guy's rantings will tip the scales of justice in his favor, but a gag order might be advisable to cut him off from committing more stochastic terrorism.

Agree the penalties should be set out up front. And if it's done in his name, he owns it.

The old line applies.. He has the right to remain silent, but not the ability to do so.

several options. I think about each of them. The idea that these would in any way "play into Trump's hands" would require one to think Trump is in control of what happens in the court. And that is utter delusional thinking.

can be seen as significant primarily in assisting in Trump raising money, and potentially allowing him to win a divided republican primary. But it will also knee-cap him if he is their 2024 candidate. This, of course, applies specifically to if he is only indicted in Mangattan. Further indictments will inflict more severe damage to Trump's future, as we will see by July 4.

I also agree that more indictments are coming.

He will be tangled up in lawsuits.

His big mouth costs him votes with critical voting blocks. He will only get more unhinged as the walls close in.

I learned that if your dog kills a chicken, to tie the dead bird around the doh's neck for 96 hours. The only exception is a husky. Trump is not a husky ..... he is a dead chicken to be tied to republican throats. Trump helped our party in 2018, 2020, and 2022. He continues to be increasingly whiny. And whiny isn't attractive to anyone not in the maga cult.
