The end of stare decisis proves the complete politicization of the Court

4. That's what I have been saying.

Without stare decisis, without legal process, the Supreme Court is just another politicized institution. And, on top of that, if they're there to weaken the Federal government and hand power to the States, the crazy Republican governors will do everything in their power to make the Federal government useless. Once they start talking about breaking away from the United States, there will be no need for a Supreme Court.

So, why are we giving THIS Supreme Court any respect for their decisions, when they don't even see a future for their own institution?

7. If stare decisis was sacrosanct

no 13th amendment, no ex-slave could ever be a citizen of the United States. Separate but equal would be the law of the land. Throwing thousands of people into concentration camps because of their ancestry would be legal. Pretty sure people could name other cases in the past that justified in being to be reversed. A future Supreme Court could view the decision ending Roe v. Wade was bad law.
They could decide that Citizens United was bad law and reverse that decision. There is a place in the legal system for stare decis.
