Will Lieutenant General Michael Flynn ever face court martial?
Here's what Glenn Kirshner thinks:

1. Certainly answers the question of whether or not he SHOULD ...
But says nothing about whether or not he WILL.
Disappointing. |

4. This is one of the siliest memes I keep hearing...
It doesn’t MATTER if he can be called back to service. This military is not going to deactivate him for the sole purpose of prosecuting him. If he’s committed a crim, try him in civilian Court.

6. Respectfully, could you clarify on what basis you make your statement?
I posted Mr. Kirschner's statement in good faith that he made a valid argument (not a silly meme) given his military and prosecutorial background. He included an example of a case where the military did do that exact thing. If you have information to the contrary, please post, as I would not want to post anything that would be misleading in any way.

7. It's a silly meme because its been floated for months by many people...
…and because, as I said, its not going to happen. Military Courts exist to deal with crimes conducted by people under military authority. The fact that Flynn is subject to military recall does not mean that he’s not a civilian today. If the military started recalling civilians to military service for the sole purpose of charging them with civil;Ian crimes, it would blur the role that the military plays in domestic civilian activity. And for that reason, the civilian Sec Def isn’t going to let it happen.
Simple question: what crime has Flynn committed that can’t be tried in a civilian Court? |
