Ashli Babbitt: Family of woman shot in US Capitol riot demands police files

The husband of Ashli Babbitt, the woman fatally shot by a police officer while breaching the US Capitol in January, is demanding access to files from a probe into the incident, US media report.

In a lawsuit, Aaron Babbitt has asked for Washington DC police to disclose details including files revealing the identity of the officer who shot her.

An earlier investigation found there was insufficient evidence to charge the Capitol Police officer with wrongdoing.

He has not been publicly named.

Ms Babbitt was part of a mob of Donald Trump supporters who stormed the US Capitol in Washington DC on 6 January as lawmakers gathered to validate Joe Biden's presidential election victory.

The 35-year-old was part of a group that forced entry into the chamber of the House of Representatives while it was still in session. She was confronted by plainclothes officers, and one pulled out a weapon and fired it. Ms Babbitt was declared dead at hospital shortly afterwards.

Federal prosecutors have charged at least eight people who were in the crowd around Babbitt in the moments before she was shot. They include Christopher Ray Grider, a Texas winery owner who is accused of trying to kick in the Speaker’s Lobby doors; Zachary Jordan Alam, of Pennsylvania, who is accused of smashing the glass pane Babbitt attempted to crawl through; and Chad Barrett Jones, of Kentucky, who is accused of smashing another pane with a wood stick that had a Trump flag attached.

Authorities had suggested the possibility of bringing felony murder charges against rioters if Babbitt’s death was a foreseeable consequence of felony conduct by others, according to a person familiar with the matter. But they have since ruled out that possibility, given case law that allows such charges only in instances when an accomplice is responsible for a victim’s death, not a law enforcement officer.

D.C. police are required by law to identify officers involved in serious uses of force within five business days of an incident. They are also required to release video from body cameras of the officers directly involved. The law only applies to D.C. police. Capitol Police are not equipped with body cameras.

We demand to see investigation reports and look at the records of officers involved in the killing of people who, even though they may have been committing a crime (Eric Gardner) or have a records (George Floyd), the response of the officer(s) was not commensurate with the situation. There was NO way that someone should be choked to death for selling loose cigarettes. That is a cite and release crime. You show up in court and pay a fine, or do a day in jail. Same with Floyd, EVEN IF he was knowingly passing off fake $20s and had a wrap sheet longer than my arm, there is NO way that Chauvin should have stood on his neck for 9 minutes and no other cop around thought they should intervene to prevent his death.

They demand to see the investigation reports and information on the officer who, through the video, widely available, is clearly seen in a defensive posture, behind a barricade, with multiple officers drawing their weapons, telling the crowd to cease, while insurrectionists who had already broken down other obstacles and beat fellow officers, were breaking down the door and pushing Babbitt up to get through the window, with the intention of breeching and overtaking their position.

What happened is not a cause for celebration, or a case of "comeuppance". It is a tragedy. She put herself in that situation, but multiple factors facilitated her being there, the most important of which, is a coordinated right wing media that pushes lies, stated from the very top of the government, and poisons the minds of people who may be struggling to adapt to a changing world.

I am sorry this woman lost her life but they need to move on. She was trespassing and was killed. It just so happens she was the first that went through the door. If it wasn't her, it would have been someone else. Not sure why they want the officer's name.
