A federal judge has ordered the Department of Justice to turn over a memo cited by then-Attorney General Bill Barr as his reasoning not to charge President Trump with obstruction of justice as part of a lawsuit brought by Citizens for Responsibility and Ethics in Washington.

When Barr delivered the Mueller Report to Congress, he said that there was not sufficient evidence to charge Trump, a decision made “in consultation with the Office of Legal Counsel and other Department lawyers.” Barr and the Department of Justice have refused to turn over the OLC memo, which led to the lawsuit from CREW.

Judge Amy Berman Jackson ruled that the contents of the memo “call[] into question the accuracy of Attorney General Barr’s March 24 representation to Congress,” specifically that Mueller had left it to the attorney general to determine whether the conduct his report describes is a crime, and that OLC’s description of the document “served to obscure the true purpose of the memorandum,” which CREW argued was to help Barr spin his version of the Mueller Report.

After reviewing the OLC memo, Judge Jackson found that it “raises serious questions about how the Department of Justice could make this series of representations to a court,” concluding that “It is time for the public to see that [the memo], too.”

In ordering the document turned over to CREW, Judge Jackson gave the government two weeks to respond with its course of action.

40. SCOTUS would probably like to 'rubber stamp' Trump into the lost memory hole.

Won't look too good on their sainthood resume that they were installed CONTROVERSIALLY by the crookedest creature even to den-up in the Whitehouse. The one who even tried to overthrow the government. All because they refused to do the right things when they could. They could have told the truth loud and long but that wouldn't play in their narrative so we got this pile of crap with their imprimatur all over it. Everything from citizens United to nary-a-word about McConnell's misrepresentations of the appointment process lays squarely in their lap. Honorable people would be offering resignations about now.

When DOJ grudgingly showed her the memo, she saw that it was about actually strategy and arguments for Barr to quash the idea, which he had already decided to do - not predecisional as DOJ had told her in a sworn affidavit./2 Image

Notably, in a separate FOIA case brought by the NYT for WH Office of Management and Budget docs related to the freeze on aid to Ukraine that led to Trump's first impeachment, the same judge said DOJ lied to her about their contents, too. pacer-documents.s3.amazonaws.com/36/213164/0451… Image

Litigating FOIA cases -- where the govt says a doc falls under an exemption & so can be lawfully withheld -- relies upon DOJ & govt affiants being honest when describing its contents in sworn court statements. Here are two cases in which that system has demonstrably broken down.

Judges in FOIA cases should routinely demand to read the doc in question rather than deferring, sight unseen, to the government's claims about its contents when arguing that something is exempt and a case should be dismissed.

The sanction for discovering govt officials lied to the court should be more than ordering release of the doc. Limiting the penalty to release creates an incentive to lie about embarrassing docs: at worst, they will come out after a long delay that depleted their relevance. /end

time frame. But I don't see why it wouldn't be a matter that could be expedited within 24 hours.

After all, it's likely on a damn flash drive I should think. Just walk it over to her court, securely of course. I wouldn't trust sending it over via cloud.. but that would be faster.

I hope this leads to disbarment as well as some time behind bars (how ironic, eh?).

When it comes to lies, we could be seeing the entire Trump administration/family behind bars. They'll have to build a new prison just for them. No pardons allowed.
