This guy was actually arrested for crossing a police line on Jan. 5 and was released. He then stormed the Capitol the very next day and then lied to the FBI when they interviewed him.

Its pretty clear that the FBI went with the rare undercover route here because federal cases built on facial recognition hits are relatively novel. Randolphs conduct, the judge wrote shocks the conscious. After Randolph knocked over the Capitol Police officer and caused her to hit her head on a metal stair handrail, he went on to assault more officers and left her an unconscious heap on the ground.

The judge in Hale-Cusanelli's case, Trevor McFadden, ordered him to remain in custody meanwhile, ruling that his actions on 1/6, plus his virulently racist views (and some actions) merited detention.

I'm sure Trump will be charged with some crimes, mainly from Georgia and New York but I don't expect a Federal charge for instigating sedition.
The only actual evidence I'm aware of was his speech before sending them off and that can be interpreted in a non-criminal way so he won't be brought to trial.
He is being charged by some Capitol police and we will see how those go but they are seeking monetary damages, not criminal imprisonment.
Trump is expert at not leaving hard evidence that implicates him directly in any crimes. He gets flunkies to do the dirty work and orders them in an indirect way so he can always claim they misinterpreted him.
---- Note: I sure hope I'm wrong about all this. It would be soothing salve to see Trump swallowed up by a federal prison, never to be seen or heard from again.
