Couple suing city of San Jose, police over use of force in hotel altercation
By MEREDITH DELISO
Sunday, August 16, 2020

...

"It was brutal, definitely brutal. I don't think we did anything to deserve the way how we were treated," Tukuafu told San Francisco ABC station KGO, which just obtained body camera footage of the incident.

According to the complaint, two officers responding to a noise complaint acknowledged that the couple's music was not too loud before asking for their identification. After they allegedly said they would return the IDs once the couple left the hotel, the incident escalated.

Three other officers responded, according to the complaint. The couple decided to leave, and while packing their belongings, the suit claims, officers entered their room without consent. After the couple "failed the officers' 'attitude test,'" the officers allegedly struck them with batons, tasers and "sponge rounds," according to the complaint.

The couple was transported by ambulance to the hospital for evaluation of "serious" injuries before being booked and spending the night in jail," according to the complaint. No criminal charges were filed.

..I'm more and more concerned about whether I CAN comply with a cop's orders.

Many times, people are told..."Just do what the officer says to do, and you'll be fine." Good theory.

OK.... let's pretend that I give the cop(s) Zero lip. No comments to them at all.

If they tell me to put my hands behind my back... that may not be possible with 78 year old, beat-up shoulders. I'm doing physical therapy for inner-ear balance issues. I'm better than 75% of guys my age (my doc says so), but walking heel-toe is very difficult. I'm not flexible, so if they say to sit on the curb, they're gonna have to help me up... by pulling on my arms!!!! And I'm supposed to be passive about all that.
I really don't want to get maced, thumped, or tazed just because I can't do what they tell me to do.
Oh... and I'm white. If I was black or Hispanic, I'd really be fucked!

I can assure you, tell a cop to go fuck themselves if you're black or brown, and you won't be around to sue them for their actions.

You're right. Hopefully telling a cop to go fuck themselves do a justice on how hated they are. But probably not.

I'm white. I walked away from a lot of shit that would have got a black guy badly beaten or killed.

Mostly I got shoved around a bit.

My mom was a terrible example while I was growing up. She'd always tell the police exactly what she thought of them.

There were no filters on her words when she was angry, just like her own mom.

Me and my siblings would be cringing in the back seat whenever either one of them got pulled over. They could say horrible things. Sometimes you could tell the cops wanted to hit them.

I was a little jealous when my wife told me about her own grandma, who, like my grandma, liked to drive too fast and ignored any traffic laws that inconvenienced her. She would put on a sweet little old lady just driving her grandchildren to church act.

But, of course, we can't possibly discuss defunding the police, because that cost us last November.

The police get lots of training and over and over again. They know the rules. They also know they can flaunt them. That is lack of consequences to the point where it becomes culture.

Have you got a link?

If they are so bent about a tainted jury pool, shouldn't they ask for a change of venue?
