Capitol riot arrests: See who's been charged across the U.S.

More than 235 defendants have been charged in federal court. Of those, 70 were also indicted by grand juries, according to documents reviewed by CBS News.

CBS NEWS reports the following stats:
20 have been charged under a destruction of government property statute.
40 people have been arrested for assault on law enforcement officers.
195 alleged rioters charged with "restricted building or grounds" charges.
20 of those arrested are veterans and three are currently enlisted in the military.
5 worked as law enforcement officers at the time they allegedly took part in the riot.
31 alleged rioters linked to extremist groups.
29 women have also been arrested for their alleged participation.
Average age: 42
At least 111 people have been sent home after posting bail or agreeing to supervised release.

400 ongoing investigations.

15. FBI seized congressional cellphone records related to Capitol attack

WITHIN HOURS OF the storming of the Capitol on January 6, the FBI began securing thousands of phone and electronic records connected to people at the scene of the rioting — including some related to members of Congress, raising potentially thorny legal questions.

Using special emergency powers and other measures, the FBI has collected reams of private cellphone data and communications that go beyond the videos that rioters shared widely on social media, according to two sources with knowledge of the collection effort.

In the hours and days after the Capitol riot, the FBI relied in some cases on emergency orders that do not require court authorization in order to quickly secure actual communications from people who were identified at the crime scene. Investigators have also relied on data “dumps” from cellphone towers in the area to provide a map of who was there, allowing them to trace call records — but not content — from the phones.

The cellphone data includes many records from the members of Congress and staff members who were at the Capitol that day to certify President Joe Biden’s election victory. The FBI is “searching cell towers and phones pinging off cell sites in the area to determine visitors to the Capitol,” a recently retired senior FBI official told The Intercept. The data is also being used to map links between suspects, which include members of Congress, they also said. (Capitol Police are reportedly investigating whether lawmakers helped rioters gain access to the Capitol as several Democrats have alleged they did, though Republican officials deny this.)

The Justice Department has publicly said that its task force includes senior public corruption officials. That involvement “indicates a focus on public officials, i.e. Capitol Police and members of Congress,” the retired FBI official said.

18. Capitol Police Suspends 6 Officers, Investigates Dozens More After Capitol Riots




The U.S. Capitol Police has suspended six officers with pay for their actions on Jan. 6, when a pro-Trump mob attacked the U.S. Capitol in an attempt to stop the certification of President Biden's Electoral College victory, according to a department statement.

An additional 29 officers remain under investigation as part of the department's ongoing probe into the events that unfolded that day.

"The investigation into the January 6 attack remains under investigation. Our Office of Professional Responsibility is investigating the actions of 35 police officers from that day. We currently have suspended six of those officers with pay," the department said in a statement.

Capitol Police Acting Chief Yogananda Pittman further directed that any member whose behavior is not in keeping with the department's Rules of Conduct "will face appropriate discipline."

The indictment offers the most sweeping evidence so far that members of the far-right extremist group known as the Oath Keepers had spent months allegedly planning to prevent Congress from certifying President Joe Biden's victory in a bid to keep former President Donald Trump in power.

The federal charges say 52-year-old Kelly Meggs, the self-described leader of the Florida chapter of the Oath Keepers, and his wife Connie, joined four other alleged militia members to breach the Capitol.

According to the indictment, the group ascended a flight of stairs outside the Capitol in military-style formation and then went on to breach the building. Federal prosecutors say Meggs parroted language from a tweet from Trump weeks before the siege. Trump had encouraged his supporters to come to Washington on Jan. 6, saying it would be "wild."

"He wants us to make it WILD that's what he's saying," Meggs allegedly wrote in a Facebook post. "He called us all to the Capitol and wants us to make it wild!! Sir Yes Sir!!! Gentleman we are heading to DC."

Last month, the Justice Department charged three members of the Oath Keepers with conspiring to undermine President Biden's win. Officials said that Thomas Edward Caldwell, Jessica Marie Watkins, and Donovan Ray Crowl had allegedly set up training for urban warfare and riot control in preparation for the Jan. 6 siege shortly after then-President-elect Joe Biden's election victory and had allegedly briefly discussed bringing weapons into Washington, D.C., by boat.

21. A 'Danger to the Community': 20-Year NYPD Veteran Denied Bail

Over Role in Jan. 6 Insurrection




Thomas Webster, a 20-year veteran of the New York City Police Department (NYPD) as well as a former member of the U.S. Marine Corps, was unable to convince a judge that his decades of public service were enough to keep him out of jail on Tuesday.

The 54-year-old had been wanted by the FBI since late last month after he was allegedly caught on video attacking a police officer and storming a barricade during the Jan. 6 pro-Trump insurrection at the U.S. Capitol Complex. Webster turned himself in on Monday.

Appearing digitally in the Southern District of New York (SDNY) before U.S. Magistrate Judge Andrew E. Krause, the defense attempted to make the case that Webster’s character and lack of a prior record made him a prime candidate for bail. The government argued in favor of pretrial detention. In the end, the court sided with the prosecution.

AUSA: We also hear the former Marine and NYPD cop Webster calling the CPD officer a "commie piece of shit...This is a cop calling another cop that." He then calls for "more patriots" and when he's close to the Capitol says he's "ready for more action."

AUSA recalls another Capitol rioter denied bail who attacked an officer with a police shield but who showed a moment of compassion. The juxtaposition: "Webster showed an utter lack of compassion. He goes after that cop like a junkyard dog. Teeth bared. Fists clenched."

AUSA notes that Webster was wearing a bulletproof vest. Says he was prepared "not only for violence, but armed violence." Though he has surrendered his own guns, says Webster is a man who has both "access to" and a "fondness for guns." Says that this is "disturbing."

AUSA anticipates defense. Says although the election is over, Webster was influenced by an extreme and violent ideology that is not "wiped from the mind overnight." Adds that this former Marine, who named his business after Semper Fi, was trying to "subvert" the Constitution.
