Alabama Rep. Mo Brooks wants to challenge Congressional certification of election

https://www.politico.com/newsletters/huddle/2020/12/02/the-gops-electoral-mischief-491033

Rep. Mo Brooks (R-Ala.) has been telling colleagues and allies that he plans to challenge the Electoral College votes when Congress officially certifies Joe Biden’s victory on Jan. 6, as long as a Senate Republican joins him in the long-shot effort, sources tell your Huddle host.

Brooks confirmed his plans in a phone interview, adding that he is still considering objecting to the vote-counting process even if no one joins him — though he acknowledged that would be more of a symbolic protest. Brooks, echoing President Donald Trump’s baseless claims of voter fraud without providing evidence, argued that the election was “badly flawed” and that most mail-in voting is “unconstitutional.”

“In my judgment, if only lawful votes by eligible American citizens were cast, Donald Trump won the Electoral College by a significant margin, and Congress’s certification should reflect that,” Brooks said. “This election was stolen by the socialists engaging in extraordinary voter fraud and election theft measures.”

Brooks, a member of the conservative Freedom Caucus, said he has had “indirect communication” with some senators about potentially joining forces, though he declined to elaborate further. He also said he’s discussed the procedural maneuver with some members of GOP leadership, but they gave him neither a “thumbs up” nor a “thumbs down,” Brooks said.

I fully expect some of these yahoos to object. In fact, we can USE this to put pressure on Republicans to divide them.

If no Senator joins him, the nonsense ends immediately.

If a Senator joins him, then the House and the Senate will have a separate vote. If the objection doesn't pass in BOTH the House and the Senate, the objected-to votes will count.

Republicans can't stop this in the Congress (now that certification is out of the way).

Also, there is apparently federal law that is supposed to even prevent these objections if the certification happens before the safe harbor day.

this asshole, gomert, Q anon lady, probably a dozen more. I would be happily surprised if cruz or blackburn some other senator doesn't join. The objections will be voted down, but it'll be a violence-incentivizing shitshow

I didn't used to be a "throw them all out and let's start all over" person, but I'm really feeling that a lot of these fools just need to go the hell away. But then again, based on the current voting population's level of intelligence, we might be stuck with worse.

I despair for our future.

Absent competing slates of electors, this is just a PR stunt. Under 3 U.S.C. § 15, Brooks would ultimately need a *majority* of the Senate to endorse his challenge; and when (not if) the House disagrees, the electors certified by "the executive of the State ... shall be counted."

But thanks for playing, Mo.
