Lawsuits hold up Hawaii election certification

HONOLULU (AP) — Certification of Hawaii’s presidential vote was being held up Wednesday by two lawsuits, including one filed by a woman who said she ran for president as an independent but wasn’t on the ballot.

Khistina Caldwell DeJean’s handwritten complaint demands a recall election.

The state responded with a motion to dismiss the case, saying DeJean lacked standing to pursue her complaint because she was not a candidate, a representative of a qualified political party or a member of a group of 30 voters.

The state’s motion added there was no provision for a recall election under Hawaii’s constitution or state law.

Another complaint, filed by Emil Syricina, Karl Dicks, Banner Fanane and a group of voters called Klean House Hawaii, challenged the results of the Nov. 3 general election and the Aug. 8 primary in their entirety. One reason, the lawsuit said, is because the state’s new all-mail election law is invalid.

1. sooner or later frivolous lawsuits must have a financial repercussion on the plaintiffs

put a cost on this and this will curtail the process, add in other repercussions on Lawyers who participate as well

solutions are not difficult to see, but takes guts to make it happen

MauiNews.com, 11/28/20: The Hawaii Supreme Court on Friday dismissed a lawsuit contesting the state’s presidential election filed by a woman who said she ran for president as an independent yet she wasn’t on the ballot.

The court’s five members unanimously rejected a complaint from Khistina Caldwell DeJean, saying she lacked standing to file her claim...

Two other lawsuits...are pending before the state Supreme Court...One challenges the entire election while the other challenges the results of an Office of Hawaiian Affairs trustee race.

New Jersey certified for Biden earlier today, leaving Hawaii as the outrider. Can't find any updates after 11/28/20

New Jersey and Missouri certified today, Hawaii is now the lone outrider.

Is Trump trying to ensure that Biden gets in with fewer electoral votes than he did?

HONOLULU (AP) — The Hawaii Supreme Court on Tuesday dismissed an elections complaint challenging the entirety of the Nov. 3 general election in the islands, clearing the way for the results of the state’s presidential vote to be certified.

Associated Press 12/9:
Hawaii on Tuesday (12/9/2020) certified the results of its presidential vote after the state Supreme Court dismissed an elections complaint challenging the entirety of the Nov. 3 general election in the islands.

NY Times 12/9:
Election results have now been certified in all 50 states and Washington, D.C., moving Joseph R. Biden Jr. one step closer to the White House. Electors will meet in each state on Monday (12/14/2020) to cast their votes.
