Why Biden should pardon Trump -- and we Democrats should want him to

If President-elect Joe Biden hopes to fulfill his pledge to unify the nation, he should do the unthinkable and pardon Donald Trump.

Trump would, of course, be one of the least deserving recipients of a federal pardon in history. His pardon could not be justified based on his innocence or his contrition because Trump is not contrite; to the contrary, he is currently endangering our democratic processes by relentlessly undermining the legitimacy of Biden’s election and thwarting a peaceful transition.

No wonder Biden’s initial instinct was to oppose granting Trump a pardon. He actually foreclosed this option by pledging last May that, if elected, he would not pardon Trump.

But that doesn’t mean there aren’t a few good reasons to consider it anyway.

I don't support 2 justice systems. If kids can be shot and killed over toy guns, then trump can go to prison for the negligent homicide of 250,000 to 500,000 Americans.

chance of making gains in the mid-terms.

On the other hand, and this is an unpopular opinion, I think jailing Trump would be throwing a lit match into a powder keg.

For me the important thing is getting to the TRUTH of everything that's happened over the last five years, and hopefully putting in safeguards so that they don't happen again.

still have the states go after him. I dislike the bastard as much as the rest of you, but an offer of pardon would likely not be accepted and I think he’d throw the olive branch in our faces...so I say extend the hand...let NY and any other state go after him and see if he admits to guilt to get out of jail.

the charges that he's being pardoned for are true and he committed those crimes. So he would have to admit his guilt before a pardon could be offered.

He pays a fine of $750m. Putin can put it up - I don’t care. In fact, that’s better. Putin owning his ass even more tightly for the rest of his life is fine with me. He will eventually piss off the wrong “chemist” anyway.

He agrees to withdraw from politics, either as a candidate or a “pundit”. He can tweet about celebrities and sports, but no politics.

He leaves the country.

Do that, and I’m good with him getting the bigliest pardon we have in the pardon file. Joe can sign it with a Sharpie even.

What crimes will we convict him of? Being an idiot and an asshole is not a crime. Making horrible decisions is not a crime. If we prosecute a former President, will will set a precedent that our government will not outlive.

For starters, to focus on putting him behind us, at the expense of providing new guards for our future security, to paraphrase the Declaration of Independence, would be incredibly reckless, to the point of genuine negligence.

Secondly:

Obstruction of Justice is a crime.
Conspiracy is a crime.
Falsification of evidence is a crime.
Witness intimidation is a crime.
Accepting foreign assistance in an election is a crime.
Extortion is a crime.
Tax evasion is a crime.
Insurance fraud is a crime.
Bank fraud is a crime.
Stochastic terrorism is a crime.
Retaliation against whistleblowers is a crime.
Criminally negligent homicide is a crime.

There is NO shortage of criminal statutes he is CLEARLY guilty of violating. And you can bet your bottom dollar that if he (and all of his enablers) do not face criminal liability for their conduct, where it clearly was criminal, the criminal conduct WILL get worse in the future.

But do we need tp give Trump a public platform to spout his hate for the next four years? Do we want to keep his base fired up. Wouldn't it be better if he was just gone?

Our battle is not over with placing Biden in office. Almost half of the country still supports Trump, we need to do things to thin those ranks, we will not do that by keeping their hate stirred up.

Understand this, personally, I would like to see Trump broken, homeless and friendless, ruined and in jail and I believe that he deserves all of that. I don't think that that is best for the future of the country.

I get where you're coming from, and in an ideal world, or even one merely as sane as the one we grew up knowing, there might be some merit to just letting him slide for the sake of mutual toleration moving forward.

But that is NOT the world in which we actually live.

In the world in which we actually live, Republicans have made it abundantly clear that toleration WILL NOT be mutual, or even ideologically consistent, no matter how much we compromise. We see this in the fact that they are STILL trying to go after Secretary Clinton over conduct that was NOT criminal, yet are simultaneously unwilling to hold Trump accountable for conduct that unquestionably WAS criminal.

In that environment, what you are talking about is deeply problematic, and all but guaranteed to ensure that the rule of law simply will not be applied to elected Republicans, even as it is manipulated and abused to try to prosecute Democrats for imaginary crimes, and we simply must not tolerate that, for ANY reason.

And one must also recognize that this impulse to avoid keeping their base stirred up (by enforcing the rule of law, which is what we're talking about here) is foolish, because history has also shown us unmistakably that Republicans and their RW media echo chamber WILL keep their base stirred up, even if they have to construct a narrative wholly disconnected from reality to achieve it. There simply is no arguing this.

They will not be placated by compromise, so to try is a fool's errand, and making that foolish mistake repeatedly is HOW our political landscape got drug so far to the right. They retreat to the right, we follow, they lurch further to the right and complain that we won't meet them in the middle. It has to stop.

Furthermore, Trump will find a platform to spew his hate for the rest of his life, no matter what anyone does. That is simply who he is. What you suggest will not make him go away, it will simply enable him to continue to spew his bullshit without consequence, which is what got us in this mess in the first place.

Your idea is noble, but it cannot be effective in the current reality.

69. No, there must be justice, with hands-off Biden. Here's what I want to see happen.

I want to see Dems like Maxine Waters, Ted Lieu, Adam Schiff etc (between now and Jan) threaten that there must be investigations into all Trump's Federal crimes.

Trump resigns, and President Pence pardons him of his Federal crimes, and all that entails as regards admittance of guilt, as well as further inability to plead the Fifth. If Dems ever get their messaging together, they could then go to town on Republicans for that.

Biden is then saved from being forced to go after Trump (or saved from having to say no), and is seen to have clean hands.

Then Letitia James can then go after him for his many State crimes.

To deter any future intelligent Trump, there must be some accountability.
