Texas appeals court upholds order against Gov. Abbott's mail ballot drop site limit

AUSTIN — A state appeals court on Friday upheld a lower court order that blocked Gov. Greg Abbott’s limit on mail ballot drop-off sites.

The ruling from the Austin-based Third Court of Appeals means the state cannot enforce Abbott’s order limiting counties to one mail ballot drop-off site.

But the state has indicated it will appeal the decision to the Texas Supreme Court, which would prevent the appeals court ruling from going into place until the higher court makes a decision on the case.

“We are two-thirds of the way through a journey that will end with the Supreme Court of Texas deciding whether under Texas law it was lawful” for counties who intended to use multiple drop-off sites to do so, said Myrna Perez, an attorney for the groups and voters who brought the case.

Counties like Harris, Travis and Fort Bend had announced plans to offer voters multiple mail ballot drop-off sites to help voters avoid long travel and long lines where they could risk exposure to COVID-19. But on Oct. 1, Abbott issued an order limiting counties to one drop-off site citing security concerns.

We are about halfway through early voting now, but this needs to get ruled on anyway, for next time.

In Harris county, as long as we still get to have our 11 drive through voting centers, that may be a better option anyway.
