Do not ever forget that these Religious freedom nuts wrote into the Indiana law that not only could businesses claim the right to deny same sex couples but also any form of marriage that they did not approve -- including interracial marriages.

10. Ask her whether Marbury v. Madison was decided correctly.
In that case, decided in 1803 by people who were around when the Constitution was written, the Supreme Court held that it had the power to interpret the Constitution, even though the power of judicial review by the Supreme Court does not appear anywhere in that document. If she's a true originalist she should say Marbury was wrong, which would take away the court's power to interpret the Constitution and put them out of a job.

12. Ask about the 14th and 15th amendments
IIRC, she's written implying they're not valid as the Confederate states didn't vote on them. So which particular rulings is she going to throw out based on that reasoning: birthright citizenship? corporate citizenship? the ability of ex-cons to vote?
And ask her why she didn't include the 13th in that analysis: the same reasoning should apply. |
