The Michigan Supreme Court issued a split decision late Friday that ruled against Gov. Gretchen Whitmer in a battle over her power to extend emergency declarations used to mandate COVID-19 restrictions over the last five months.
The court's opinion throws into question dozens of orders issued by Whitmer related to the coronavirus pandemic, appearing to void them. At the same time, however, since the decision came as a response to questions submitted to the court by a federal judge and not as part of a state case before it it wasn't immediately clear what would happen next or when it would take effect.
Whitmer issued a statement denouncing the decision.
Todays Supreme Court ruling, handed down by a narrow majority of Republican justices, is deeply disappointing, and I vehemently disagree with the courts interpretation of the Michigan Constitution," she said. "Right now, every state and the federal government have some form of declared emergency. With this decision, Michigan will become the sole outlier at a time when the Upper Peninsula is experiencing rates of COVID infection not seen in our state since April."

(5,499 posts)They are saying that after 28 days, the governor cannot issue another state of emergency order. I think the intent of the law is that the legislature can come in an extend an order for longer th as n 28 days. So for instance, the governor issues th he state of emergency for 28 days and the legislature extends it for 90.
But if the legislature fails to extend, the governor has to renew the state of emergency every 28 days.
The state is so gerrymandered that Republicans have a tight grip on the legislature. But we passed a law where the districts have to be redrawn by a nonpartisan committee.
The Michigan Legislature was pro people dying. Period.
