The Obama administration's position is that they are going to leave it up to the states. They've subsequently used federal authority to prosecute people that they claim are doing more than just selling for more than medicinal purposes. I think their claims may be dubious and fuck I don't agree with the war on drugs to begin with. But I seriously doubt that Mary Beth Buchanan or whatever other fucking lunatic Romney appoints to be Attorney General is going to take a more hands off approach than Eric Holder?
