5. No, he still has to wait longer as he was fired before turned 50, required for Fed Law Enforcement

Since he got fired right before his 50th birthday with 21 years service, he now has to wait until an older age to draw- normally 57 for Federal Law enforcement or 62 for most Feds who leave before they are old enough to get immediate pension.

He has sued though to get his pension restored so the lack of criminal indictment will help his wrongful termination case since it was apparently politically motivated by Trump.

4. Didn't want to risk a dismissal with prejudice. This preserves the viability of the case in the

event that new evidence is uncovered. Of course it also means they could butt up against the statute of limitations.
