North Dakota Tribes Score Key Voting Rights Victory

North Dakota officials have reached a settlement with two Native American tribes over the state’s restrictive voter identification law.

The settlement, announced on Thursday, includes a legally binding consent decree to ensure that Native American voters are not disenfranchised. It is a major victory for the tribes and — pending formal approval by tribal councils — will resolve two lawsuits challenging the constitutionality of the law, which requires voters to show an ID with a residential address.

Many Native American reservations do not use traditional addresses, and the law — which the Republican-controlled North Dakota Legislature passed shortly after a Democrat, Heidi Heitkamp, won a close Senate race in 2012 with strong support from Native Americans — meant they could not vote with an ID that listed a post office box as an address. Ms. Heitkamp was defeated by Kevin Cramer, a Republican, in 2018.

Under the new consent decree, the North Dakota secretary of state will be required to ensure that Native Americans can vote even if they don’t have a residential address, or if they have one but don’t know what it is. (In many cases, buildings have an official address in county records but no signage, and tribal members have never used the address.)

1. Tribal leaders should just let the members pick their own addresses...

come in register with the tribal admin office. Make it official.

5. HOORAY!

This is a BEAUTIFUL VICTORY, and the Northern Tribes are AWESOME for achieving this! It is especially great at this difficult time in our history! And it is so great a victory that it actually STRENGTHENS THE RIGHTS OF everybody else, too! This will be remembered and quoted in many other courtrooms and legislatures, for a very long time!

6. Wow, I had kind of written this off as a loss since Native Americans have historically been screwed

7. Now get South Dakota to fix their problem, not allowing Indians to vote without address.

The Pine Ridge Sioux reservation in So. Dak. is a big reservation.

GOP-dominated House bars tribal IDs for voter registration

South Dakota Democrats called foul on Friday after the Republican-dominated House shot down their efforts to allow Native Americans to use their tribal IDs to register to vote.

The defeat Thursday evening prompted several Democrats to level accusations of voter suppression. Republicans say their resistance is all about keeping voter registration secure.

"The way our voting system is set up does disenfranchise particular Native American voters," said Rep. Ryan Cwach, a Yankton Democrat.

In the 2018 general election, tribal communities reported some of the lowest voter turnout figures in the state. Native Americans make up 9% of the state's total population.

On Thursday, the House considered an amendment to a voter registration bill that would have allowed tribal IDs to be used for voter registration, alongside state drivers' and nondrivers' licenses and social security numbers. Republicans defeated the measure, arguing that the secretary of state could not verify the information on the IDs, which are issued by the tribes. They were also concerned that not every tribal ID provides an address, which could allow people who live outside the state to vote in South Dakota elections.

Rep. Shawn Bordeaux, a Mission Democrat who is a member of the Rosebud Sioux Tribe, said tribes in the state have improved the quality of their IDs in recent years. They now include addresses, holographics and other security measures. They are recognized by federal agencies and can be used to take flights...
