An interesting exchange between Noah Rothman, Mimi Rocah, and Steve Schmidt on impeachment

It probably makes the most sense to read this bottom to top, since the most recent tweet is first:

Steve Schmidt
@SteveSchmidtSES

“The will of the voters” was to grant Article 2 Executive authority to Trump. Trump obligated himself, through the Presidential Oath to be faithful to the Constitution. He broke that oath. Impeachment is the Constitutionally prescribed remedy.

Don’t think we misheard you. Your language on @MSNBC & your language here (“overruling the will of the voters”) is absolutely implying that impeachment is an illegitimate process because it undoes something that shouldn’t be undone. If that’s not what you meant, please clarify.

Noah Rothman
@NoahCRothman

It seems you heard me say that impeachment was not an appeal to a constitutional mechanism. I did not say that. If we have a rhetorical problem with "overturning," let's say "overruling" the will of voters. The historical gravity of D's actions is unchanged w/ the synonym.

Mimi Rocah@Mimirocah1

Impeachment is about possibly removing a president who has engaged in certain kinds of bad acts since the election. Saying it’s “overturning” ignores that sequence. It’s in the Constitution because framers worried about presidents who do bad acts after, & or during an election.

WATCH: @NoahCRothman: Impeachment "is about removing this president from office, overturning the 2016 election."

@ZerlinaMaxwell
: "It's not overturning the election it would make Mike Pence the president." #MTPDaily

1. To paraphrase Chris Hayes

By definition, any removal from office via impeachment would overturn an election, but the founders put it in the Constitution, anyway.

3. correct, and just to avoid superfluous removals,

founders put in 2/3 of senate required to actually remove. So if the senate reaches that level of 2/3,
it no longer applies that it was a casual over turning of an election.

6. NO...not an overturning of the election if the Vice President is installed.

Was he not elected to serve if the President could not compete his term?
This is a purposely misleading argument.

4. This whole "undoing the 2016 election"

is such complete BS! That's not what this is at all. Although, I wouldn't have minded if we could have undone it on December 1, 2016!

Who is this Noah character? He is an idiot.

11. It overturns the result of the election but not "the will of the voters"

The majority of voters rejected Trump. If anything, impeachment and removal will accede to the will of the voters.

12. "Overturning" or "overruling" is semantic nonsense

It's language designed to make impeachment and removal appear to be illegitimate exercises of power by Congress, instead of the legitimate remedy mandated by the Constitution.

If the 2016 election result was being overturned, Hillary Clinton would become president on Trump's conviction and removal from office. But that's not how it works, and Noah Rothman knows that very well. Or he should know that very well. Also, this "will of the people" nonsense is just too precious for words: The plurality of voters, by 2.8 million votes, preferred Hillary Clinton to Donald Trump. If anything's illegitimate and counter to the will of the people, it's the electoral college.

13. Noah Rothman is an annoying slime bag & anytime he starts to speak I change channels or turn off vik

Even just watching him without volume you see the nastiness and attitude. He likes to annoy and agitate and he is disgusting. Wish MSNBC would not book him because it turns good conversations into unbearable.
