Trump admin attempted to conduct an illegal covert psyop on the American public...

says Asha Rangappa (former FBI Agent, CNN analyst, Lecturer at Yale) Here's her tweet thread in full (the clip she references is the CNN video showing the text messages from Volker).

One thing not to overlook in understanding the significance of the texts is that in addition to soliciting section assistance and abusing his power, Trump was attempting to employ covert propaganda against the American public:

As I note in the clip above, one thing the texts make clear is that the administration wasn't just interested in Ukraine investigating Biden -- they were specifically interested in the *messaging* about the investigation. If what you care about is "corruption," you would be satisfied with an assurance that Ukraine was going to investigate. Instead, the Trump admin doesn't care so much about the investigation itself, but making sure that the fact that it is being investigated is *being broadcast* to the audience they care about: American voters.

IMPORTANTLY, they are very invested in the message being crafted in a *specific way* -- tailored to Trump's benefit by maximizing the "seeds of doubt" on both Biden and the 2016 election. It's being drafted by Trump's personal lawyer! In addition, the message was going to be delivered as an official statement from Ukraine, with NO INDICATION that the United States either precipitated or participated in its creation in any way. This, folks, is called black propaganda. Black propaganda attempts to conceal the true source of information, so that the target cannot accurately assess the credibility of the message or the motives of the source behind it.

Trump wanted to cloak his own role and motives behind a statement of a foreign country The goal here is to manipulate the American public into to thinking that Ukraine had *independently* reached the same conclusions about the Russia investigation, and/or uncovered criminal leads about Biden. Trump could then use this to bolster his own views.

Not for nothing, but a good chunk of the cases I investigated in the FBI were "perception management" (propaganda) cases. We actively try to STOP foreign countries from doing this to us, because we believe that part of an open society and marketplace of ideas is ensuring that people know the true source of information in order to assess credibility and critically evaluate the content (FARA originated in 1938 as a way to combat Nazi propaganda, be requiring state-sponsored content to be identified as such) Basically, you have the Trump admin attempting to conduct an illegal covert psyop on the American public, using officials from the State Department and his own attorney to do it. It's literally a version of what Russia did in 2016. /END

10. If he is so concerned about

corruption, there is plenty to investigate in his own WH. Start with Kushner and the Saudi $$$$ to bail out his family. How about the Kushner family selling visas for $500,000? Actually that was for investing in a Kushner company, they got a US Visa. Investigate Ivanka's multiple trademark deals through Jyna. (China to the rest of us) That would keep the entire administration busy for a while.

11. The Ukrainians didn't need to actually find anything on the Bidens

We know how Trump campaigns; he was already making slanderous, evidence-free accusations that the Bidens had committed untold heinous crimes (although he can't quite say what they were). Being able to say that the Bidens were so suspicious that the Ukrainians were investigating them would make his baseless assertions 10 times more credible. Yes, it was a psyop, and it worked so well with Hillary's emails, why not use the same strategy again.

12. what she and rachel maddow, for instance, are missing is

that, in this trump time, talk radio is a much more important player than social media. limbaugh is a friend of trump and guiliani and was talking up the ukraine biden angle since june at least. trump had sam nunberg listen to "1000s of hours of talk radio" in 2014, the same year a russian troll said he"got lists of topics to write about"

did rachel in writing about putin's fossil fuels disaster mention limbaugh's radio empire was a central player in selling 'climategate', which started from a russian hack, involved wikileaks, and within 5 days the emails were reduced to talking points for limbaugh to start on monday and go all week on it to derail obama at copenhagen and delay action on global warming another decade, saving putin hundreds of billions.

1500 coordinated radio stations are classic PSYOPS, a dream psyop working the US over for 30 years and increasingly influenced by the kremlin

13. Well...you're not going to want to hear this. I did not.

But...

The National Defense Authorization Act (NDAA) for Fiscal Year 2013 authorizes the domestic dissemination of information and material about the United States intended primarily for foreign audiences, and amends the Smith-Mundt Act of 1948 to allow propaganda to be disseminated within the borders of the United States. By the government.

So psyops by the US government, directed at us, for the purpose of managing public opinion is actually not illegal.

And, you know what? I would be absolutely DELIGHTED if someone reading this can cite something that proves what I just said wrong, because this law is deeply, deeply flawed. Like Rudy said, it seems that these days, truth is not truth.

15. Steven Cash unpacks this for us....

Cash (Lawyer, national security consultant, former Chief Counsel, Terrorism, Tech. & Homeland Subcommittee (M), former New York City Prosecutor; former CIA officer) has a thread in response to Asha's tweet that I believe unpacks what you're talking about. Here it is in full (I've corrected some of his typos):

Let’s unpack that. Covert Action is legal, but constrained. In fact, defined (and regulated) in law at 50 U.S. Code § 3093.

"Presidential approval and reporting of covert actions” All quotations are from that statute, which you can read at https://law.cornell.edu/uscode/text/50/3093 RECOMMEND READING THE STATUE - CLEAR AND EASY

Is what POTUS doing Covert Action? Definition (from 3903): “‘covert action’ means…

…an activity or activities of the United States Government to influence political, economic, or military conditions abroad, where it is intended that the role of the United States Government will not be apparent or acknowledged publicly.”

Exactly what POTUS was trying to do (and why he did not [use] ordinary channels to publicly ask, and why he kept it so secret)

When can POTUS do it?

When the “President determines such an action is necessary to support identifiable foreign policy objectives of the United States and is important to the national security of the United States.”

Here, there was no foreign policy objective, and not important (in fact contrary) to nation security interest.)

How does he do it? In writing (in what is called a “Finding”): such determination “determination shall be set forth in a finding...

Who carries out?: The CIA, or another part of the CIA (but they have to follow CIA regulations, which preclude actions against US Persons, or there own written regulations )

Who needs to be told?

His thread starts here: <blockquote class="twitter-tweet"><p lang="en" dir="ltr">1/ Let’s unpack that. Cover Action is legal, but constrained. In fact, defined (and regulated) in law at 50 U.S. Code § 3093.”</p>— Steven A. Cash (@cashsteven1) <a href="

Legal vs illegal in the US, what's that even mean? What did that ever mean?

At one point - Legal to keep slaves. Illegal to help them escape
Today - Legal to value profit margins over human lives or public health when it comes to our "world's greatest healthcare system"

...Why not do it again ins 2020. This time they are using (or trying to use) the levers of the government to carry out the operation.

Trump supporters, who only get their news from Trump propaganda outlets and news feeds, get the sense that the conspiracy theory is real.

The problem here is that not only are conspiracy theories drummed up out of thin air, but Trump has a massive propaganda operation, including the entire Republican party, whose job it is to mix them into our discourse and confuse the public.

It is a big big problem. This country has got to somehow deal with this or we face a slow walk toward fascism in this country. This is not hype, it is a real threat that we must take seriously.

He lives in a fantasy world where all he imagines becomes his reality. As long as no one is calling him on anything he will get away with it. The fact that neither the Biden camp nor the DNC have made an opposing position clear allows his narrative to carry the day.
Immediate factual responses by as many parties as possible are needed everyday. The repetition of lies allows them to enter the conversation, so would the repetition of facts if they had the same air play.
He is winning a shouting contest.

26. That's what I've been saying for some time...

This wasn’t about blackmailing Ukraine to investigate the Bidens, it was about blackmailing Ukraine to fabricate phony evidence to make the Bidens look guilty, no matter the actual facts.

We needed to make that clear from the start, because I’m guessing there’s a high probability that Zelensky will give in (seems he already has started doing so) and manufacture evidence implicating the Bidens. At which point, unless we’ve framed the issue as I detailed above, you can be sure that Trump and his lackeys will play it to the hilt, declare that this “proof” justified Trump’s demand for an investigation, and assert that any impeachment inquiry is merely Democrats trying to cover up efforts to show the corruption of their leader. And lots of voters will fall for it. That’s why we always need to be careful to frame things accurately, in accordance with the facts, and not in a way where we are inadvertently reinforcing the Republican narrative.

33. This, I assume, is Trump's way of expanding his base

He can't expand that base on the merit of his ideas (he has none), so another con is put into place to cast doubt on any credible opponent. His existing base eats this stuff up, even when the plot is broken wide open. The very notion that Donald Trump is concerned about corruption is laughable, except for those already brainwashed. But sowing the seeds of doubt is what disinformation and misdirection is all about.

Which is why the focus needs to stay on Donald Trump, his actions, his betrayal. This is all about him and his enablers, going as far as threatening the entire country with a civil war.

This is all about Trump, the biggest national security threat the country has ever seen. Trump is the enemy, the snake inside the tent. Defeating him is the only thing that matters.

45. Is anyone violating the Hatch Act?

The Hatch Act

The Hatch Act restricts federal employee participation in certain partisan political activities. The political activity restrictions apply during the entire time of an employee’s federal service. Certain rules prohibit both on-duty and off-duty conduct.

Partisan political activities are those activities directed at the success or failure of a political party, candidate for partisan political office, or partisan political group. While most Federal employees are permitted to take an active part in partisan political management and partisan political campaigns, the Hatch Act does prohibit certain participation by all Federal employees. Federal employees may not seek public office in partisan elections, use their official title or authority when engaging in political activity, solicit or receive contributions for partisan political candidates or groups, and engage in political activity while on duty.

FDA employees are categorized into “less restricted” and “further restricted” employees.
