Barr made final decision to not prosecute Eric Garner's murderer:

NEW: A senior DOJ official said AG Barr made final call on decision not to move forward in prosecuting Officer Pantaleo in #EricGarner's death, siding with EDNY recommendation over DOJ's own Civil Rights division, which *recommended prosecution.*

The U.S. Justice Department had faced a deadline Wednesday, the fifth anniversary of Garner's death, to decide whether to file civil rights charges against Pantaleo or others involved in the fatal arrest on a Staten Island sidewalk. The statute of limitations on most federal charges is five years.

23. civil rights ... vs. manslaughter

I don't understand why this isn't a trivial case for manslaughter instead of a civil rights case. You might not be able to prove intent, but that's not required for manslaughter! Yes? Thankfully I'm not a lawyer, but this case has me pretty confused why they don't just charge him with manslaughter.

26. Because murder is generally a state crime, not a federal one.

There is a very limited range of murders that fall under federal jurisdiction, and this one isn't one of them. Some examples are the murder in the course of an interstate kidnapping and killing a federal agent or official (although, until after the Kennedy assassination, it wasn't a federal crime to murder a president - Lee Harvey Oswald was charged under Texas, not federal, law)

However, when a murder like this happens and the state doesn't prosecute, the Justice Department can prosecute it under its authority to enforce civil rights laws, which is why it would bring this as a case against the police for violating Garner's civil rights.

I know it sounds weird, but this is the only way the feds can do it.

Washington (CNN)Attorney General William Barr made the decision not to bring federal civil rights charges against the New York Police Department officer accused of fatally choking Eric Garner, siding with a Justice Department team from New York over the Civil Rights Division in Washington due to concerns that prosecutors could not successfully prove the officer acted willfully, a senior Justice Department official said.

The decision to not pursue the charges against the officer, Daniel Pantaleo, came after a dispute between the teams, the official said. Barr made the decision after viewing the video showing Garner's takedown several times and quizzing both groups of attorneys.

It is not unusual for the attorney general, as the head of the Justice Department, to make final prosecution calls.

The divide between New York prosecutors and civil rights officials in Washington, DC, existed as well under the Obama administration, creating a stalemate that left the case unresolved before Donald Trump was elected President in 2016, CNN has reported.

To see her do that in plain sight, with so many people watching her right behind a potential Supreme Court Justice, was mind boggling.
