Trump and the House Oversight committee have filed for an expedited appeal of Mazars ruling

Zoe Tillman

@ZoeTillman
NEW: Trump's lawyers and the House Oversight Committee have asked the DC Circuit to expedite his appeal re: the subpoena to his accounting firm. If the court agrees, the House agreed to suspend the deadline for the company to produce documents

This is significant — if the court agrees to this schedule, and the House suspends the deadline for Mazars to produce docs, this avoids a fight over an emergency motion to stay the lower court order (the district judge denied a stay request, see: https://www.buzzfeednews.com/article/zoetillman/house-democrats-subpoena-trump-accountant-judge-rules …)

A fight over an emergency stay request would delay getting to a final ruling on whether the House subpoena is lawful — if Trump lost on an emergency motion in the DC Circuit, for instance, he could petition SCOTUS to get involved. So this would move things along more quickly.

Here's House Oversight Committee Chair Elijah Cummings on agreeing to suspend the subpoena deadline if the DC Circuit agrees to expedite the case: "I hope the Court approves our request so we can move forward and effectively discharge our responsibilities under the Constitution."

The deadline isn't firm because Trump could still get a stay from an appeals court. pnwmom May 2019 #10

the process to a final decision.

I'm more surprised Trump would go along with this.

Oversight would rather have a complete review from the appeals court on an expedited basis.

If they didn't do this, the appellate court probably would have issued a stay pending its decision and there would be no guarantee the decision would come quickly - meaning the documents wouldn't be produced for an undetermined period as the court decides the case.

This speeds up the process and resolution.

because it bypasses the whole process of appealing the denial of the stay.

but the Oversight Committee has the benefit of some of the best lawyers in the country both on its staff and as advisors.

They know what they're doing.

The OP is about the Mazars hearing earlier in the week (the accounting firm.)

There's so much going on this week it's hard to keep up.

One offering to hand over their state tax records on Trump to Congress; and the other exempting people who had Presidential pardons from NY's double jeopardy laws.

Trump is having a very bad week!
