In United States constitutional law, the penumbra includes a group of rights derived, by implication, from other rights explicitly protected in the Bill of Rights.

In Griswold v. Connecticut (1965), the Supreme Court ruled that a state's ban on the use of contraceptives violated the right to marital privacy. ... Justice Douglas contended that the Bill of Right's specific guarantees have "penumbras," created by "emanations from these guarantees that help give them life and opinion."

Many are not pleased with this conclusion, and many, including Justice Ginsburg I think, were not pleased with Roe's conclusion, thinking it was better left to the states.
