Question: IF Barr did what we know he did, would this make tRUMP a co-conspirator?
UNABLE to pardon BARR? Just wondering.

1. Technically, Trump can pardon co-conspirators.
The limits of pardon have never been tested. At this point, it's not even clear anyone would have standing to contest a pardon.

I thought that IF he is a co-conspirator he COULD NOT pardon? Just trying to understand the process. TY

5. Yes, it's a plenary power, meaning no real limits.
Bush I pardoned the Iran Contra conspirators. Some say he was a conspirator, but that was never proven, and it never went to court.
Any court challenge now is uncharted territory. |

6. it's extremely unlikely that a presidential pardon would be deemed invalid
as long is it related to a federal crime that already happened (he can't pardon future crimes or non-federal crimes).
the only sort-of question is whether or not he can pardon himself. i think that's a clear no, but i'll grant that it's a fair issue. now, once he does grant a pardon to a co-conspirator, that could be deemed a high crime and misdemeanor that he could be impeached and removed for. it could even be deemed to be an obstruction of justice or part of a witness tampering case against the president (e.g., if the pardon was a payoff for lying). but the pardon would still stand, even if the president then goes to prison for having granted it. |
