there's really no way rosenstein -- or any lawyer -- seriously discussed invoking the 25th amendment

the very first step and the absolute minimum research needed in any plot to use the 25th amendment to remove the president is just simply reading the damn thing. the relevant section is only one paragraph.

reading it would quicky make anyone with basic legal training (or almost anyone else who isn't fantasizing, really) realize that it's a really, really hard way to remove a president who is capable of objecting to it.

you would need:

- the vice-president
- a majority of the cabinet
- 2/3rds of the house
- 2/3rds of the senate


after reading that, the tiniest moment of thought would make anyone realize that it's way harder to remove a president through the 25th amendment than it is through impeachment, which only requires:

- 1/2 of the house
- 2/3rds of the senate

if that group won't impeach, how will that same group *and* another 1/6th of the house *and* half the cabinet *and the vice-president all agree on removing him?

simply. it's not happening unless donnie's in a coma or incapacitated (in the usual sense) after a stroke






now, it's fun for us random people on discussion boards to have fun talking about the 25th, and to use it as a joke to describe how we all know he's crazy and not qualified for the job.

but someone like rosenstein is
(a) not going to waste any time thinking about this beyond the minimal amount of though i described above needed to entirely dismiss the idea and
(b) definitely not going to let anyone think he's actually looking into this. that would be astoundingly stupid.



really, the only reason this claim is out there is because someone wants to dupe people into thinking that rosenstein is trying to remove donnie via the 25th.

Someone at NYT should lose their job over this. There is no way a deputy AG strolls in there and tells them to dump the President. It's absurd.

Maybe Rod Rosenstein did have a conversation in which he was asked and proceeded to explain how it would work. I'm thinking specifically about Steve Bannon who is quoted in "Fire and Fury" (Michael Wolff's book) as having mentioned the 25th and explaining it to Cheeto. We can guess that Cheeto hasn't read the Constitution, and certainly had no clue about 25A.

Answering a question isn't the same thing as being the person who goes around talking it up among the Cabinet secretaries. Rosenstein would never do that! I don't believe Rod's boss Jeff Sessions would ever do it either. And Sessions would have had reason to, but it's a moot point. Never happened!

it's reported elsewhere just reported on this. You can take it to the bank this is just to get the assholes ginned up to give Trump cover and a reason for firing him.
