Brett Kavanaugh's Supreme Court Chances Just Got A Lot Worse

Lost in the mix, however, is some rather alarming news in the confirmation process for Trump’s Supreme Court nominee, Brett Kavanaugh. According to a letter signed by Senators Dianne Feinstein (D-Calif.), Patrick Leahy (D-Vt.) and Dick Durbin (D-Ill.), Senate Republicans are refusing to hand over documents pertaining to Kavanaugh — documents that could include damning evidence that’d surely kill the judge’s confirmation process before it even begins.

The senators’ letter to Chairman Chuck Grassley notes that the Republicans have only made available around three percent of documents covering Kavanaugh’s record. A full 98.4 percent of Kavanaugh’s record is being withheld. The senators noted that, by comparison, 99 percent of Elena Kagan’s record was made available to the committee prior to her confirmation process. Stating the obvious here: it looks like they’re hiding something. Duh.

And this might be the something. Kavanaugh might’ve lied under oath during his prior confirmation hearing in 2006. The senators wrote:

As you know, in 2006, Judge Kavanaugh told the Committee under oath that he was “not aware of any issues” regarding “the legal justifications or the policies relating to the treatment of detainees”; was “not involved in the questions about the rules governing detention of combatants”; had nothing to do with issues related to rendition; and was unaware of, and saw no documents related to, the warrantless wiretapping program conducted without congressional authorization.

The Republican Party's leadership is dedicated to enrichment of the 1% and enslavement of the working class. Unfortunately, for the present and foreseeable future 30% of the citizens have been so totally brainwashed by the incessant hated broadcast 24/7 that they are totally oblivious to fact that they are cooperating in their own destruction.

They are analogous to the Germans during the 1930s that swallowed the same propaganda that brought about their ruin. Its the same old story of the use of scapegoats to provide the desperate with a whipping boy to take out their frustrations of their inability to succeed. It is speaking to a large class of citizens who are minimally educated and have been replaced by automation. Those jobs that provided the minimally educated with substantial earnings attributable to unionization are gone and their only hope for employment is in menial jobs at starvation wages. In Germany it was the Jews, in Trump's delusional world its the immigrates. Trump is leading a major portion of our citizens down a dead end road that leads to a waste land of no hope. Rather than confronting the challenge and providing the tools for success, he is holding out false hope for a time that has long past. The situation is really pathetic. Unfortunately, I don't have a great deal of compassion for those whose only response is hatred and division as the balm they wallow in to pacify their failure.

The retiring GOP senators may be willing to speak out against Trump, but I doubt they would rank the SCOTUS pick over this procedural issue. They could have stood up for principal when Garland was nominated and to my recollection they were silent.

Perjury and concealment of records, not for a minor matter, but to conceal information that could have caused the senate to not confirm him would be a huge matter.

And Kavanaugh was chosen not just for his extremism and willingness to reinterpret our constitution beyond recognition but for his young age. They want this appointee to be there for the next 40 years anyway.

Obviously, his record as an appellate judge if by far the most relevant data when considering him for SCOTUS... and all of that is available. It seems like they’re trying to count every piece of paper he’s ever been involved with as equally a part of the record. How many people would be swayed by that?

It’s like arguing in the opposite direction that you turned over 99.9# of subpoenaed documents (in a “document dump”), so it isn’t a big deal that a few were missing... when those few pages were the ones they most wanted.

They’re going to run into republicans asking “so you found nothing objectionable in hundreds of rulings that he authored???”

But if they argue this correctly, they should be able to keep the focus on the fact that he lied under oath, and since Republicans are refusing to release his records, what are they hiding? These are the people who tried to impeach Clinton for having sex with an intern, but claimed it was because he lied under oath. Unfortunately, Democrats tend to let their opponents set the parameters of the discussion, and then stay with-in the lines, while Republicans break every rule they themselves set out. If they can get out and stay out in front of this issue, it'll stick. On the bright side, I'm seeing more and more spine being displayed by Democrats lately, so keeping my fingers crossed.

They wanted to know whether or not he worked on certain issues for the Bush administration. He said that he didn't. They would like to prove that he lied.

The problem is that they don't have any evidence that he worked on those issues... just that he talked about them socially (like all the rest of us at the time).

Maybe I'm missing something. The Repubs have the votes needed to confirm him, don't they? There is nothing short of confession or proof of outright murder that will keep those Repubs from voting for him.
